I am referring to the opening scene in the "The Negotiator" movie:

Proponent party: Danny Roman (the police hostage negotiator)
Opponent party: Omar

The targetted goal of the negotiation: To rescue the hostage being kidnapped by Omar.

The negotiator's edges and best alternatives: Danny agreed to let Omar to be with him with a gun pointing at him in exchange with the chance to let him in to the unit to examine if there was any "surprise" or other hostage there.

Timing factor involved: Danny kept on talking while he was in the unit to distract Omar, and he managed to signal the police to shoot down Omar just before Omar lost his patience and killed him.

First offer and concessions description: Omar was insisting on seeing his wife before he let off the hostage, but Danny insisted on entering the unit to examine for traps and hostages first. Danny persuaded Omar to let him in by offering Omar to shoot him if he lied. Omar agreed and brought Danny around the unit with his gun pointing at Danny's back.

Your reflection on the negotiation process in this scene: Negotiation should be within a s short time frame to be effective, and it often requires something to be put in as exchange.

I am referring to the "dividing up the grafted fund" scene in the "The Negotiator" movie:

Proponent party: Chris Sabian
Opponent party: Grant Frost

The targetted goal of the negotiation: Sabian was asking for sixty percent of the grafted fund from Frost.

The negotiator's edge and best alternatives: Sabian agreed to hand over the evidence in exchange of thirty-five percent of the grafted fund.

Timing factor invloved: Sabian was taking advantage of the time constraint as the police were approching them and they would be interrogated in a short time.

First offer and concessions description: Sabian was asking for sixty percent of the grafted fund to exchange the evidence he got from Frost but Frost disagreed on that. Sabian reduced it to be fifty percent yet Frost offered thirty percent. Sabian reduced it again to forty-five percent and Frost increased it to thirty-five percent. At last, both of them agreed on thirty-five percent. Sabian handed in the tapes of evidence and Frost destroyed it.

Your reflection on the negotiation process in this scene: Always initiate your first offer in high prices, and reduce it gradually to make it seems more accepting.

Danny persuaded Omar to let him in by offering Omar to shoot him if he lied. Omar agreed and brought Danny around the unit with his gun pointing at Danny's back.Your reflection on the negotiation process in this scene: Negotiation should be within a s short time frame to be effective, and it often requires something to be put in as exchange.I am referring to the "dividing up the grafted fund" scene in the "The Negotiator" movie:Proponent party: Chris SabianOpponent party: Grant FrostThe targetted goal of the negotiation: Sabian was asking for sixty percent of the grafted fund from Frost. The negotiator's edge and best alternatives: Sabian agreed to hand over the evidence in exchange of thirty-five percent of the grafted fund.Timing factor invloved: Sabian was taking advantage of the time constraint as the police were approching them and they would be interrogated in a short time.First offer and concessions description: Sabian was asking for sixty percent of the grafted fund to exchange the evidence he got from Frost but Frost disagreed on that. Sabian reduced it to be fifty percent yet Frost offered thirty percent. Sabian reduced it again to forty-five percent and Frost increased it to thirty-five percent. At last, both of them agreed on thirty-five percent. Sabian handed in the tapes of evidence and Frost destroyed it.Your reflection on the negotiation process in this scene: Always initiate your first offer in high prices, and reduce it gradually to make it seems more accepting.

I am referring to the first scene of Danny Roman and Chris Sabian in The Negotiator.

Proponent party: Chris Sabian

Opponent party: Danny Roman

The targetted goal of the negotiation: First one is that Danny needs his police badge again. Second, if Danny dies, he wants a department funeral. Thirdly, Danny needs to know who is the informant. Lastly, Danny wants to know who kill his partner. If Sabian fulfill all this goals, Danny will release all the hostages in return.

The negotiator's edges and best alternatives: The negotiator’s edges is so smart and professional which he have been experiencing talking to a culprit for 55 hours and got him saved with no tactical actions. Sabian who is the negotiator find the best alternative way is to talk to Danny and not having any breach. By Sabian just talking, he managed to save a hostage, Mr Frost at the beginning.

Timing factor involved: Timing is needed by Sabian to talk over with Danny, he needed more than an hour, but the FBI and other of Danny’s fellow cops deny it and wanted to full breach the crime scene immediately.

First offer and concessions description: Many offers were still on pending for Sabian to fulfill but he tried to negotiate again with annoyed Danny having a gun point towards Mr Frost. The offer was to switch on the electricity which Sabian obey. And in return, concessions occurred. Sabian asked Danny for a hostage and Mr Frost was released by Danny’s permission.

Your reflection on the negotiation process in this scene: I guess Chris Sabian had been doing a great job, it doesn’t matter how long you negotiate, what matters is that everyone should return home safely and alive. Sabian had always wanted to rescue his hostages by just negotiating with the culprit. As for my reflection, no one is a culprit since born. So the culprit might have his own injustice story. Just to voice out, the culprit might done some bad things out of control. To control the feelings and emotions going through in a culprit’s mind, a good and matured negotiator is needed to calm the situation and also turn the heat down if any crime scene happens.

Danny Roman had no other choice and therefore, if Chris Sabian was not there after 20 minutes, a hostage would be killed. Farley was unable to say no to any of the questions Danny asked and made contact with Sabian.

I am referring to the starting scene (starts 7:05) from "The Negotiator":

Proponent party: Danny Roman (the police hostage negotiator)

Opponent party: Omar

The targeted goal of the negotiation:

To rescue the little girl hostage being held by Omar.

The negotiator's edges and best alternatives:

Danny agreed to enter Omar’s premise empty-handed and solely just to examine if there was any other hostages (‘surprises’) being kept.

Timing factor involved:

Danny distracted Omar by engaging casual conversations with him, and managed to signal the shooter to shoot down Omar, after making Omar stood in a ‘clear visual’ spot of the shooter.

First offer and concessions description:

Omar insisted on seeing his wife before letting go of the hostage. However, Danny insisted on checking the premise prior to bringing Omar his wife. Danny persuaded Omar to let him in by offering Omar the chance to shoot him, more specifically, letting Omar held the gun at him all the time while he’s in the premise.

Your reflection on the negotiation process in this scene:

Negotiation are best done with sufficient patience, finding the right chance and ensuring criminal is vulnerable at a point to be successfully taken down. Compromising the criminal’s requirements is rather crucial when time is running out and hostage’s safety is in great threat.

I am referring to the "Put the power (electricity) back on" (1:21:34) scene from The Negotiator movie:

Proponent party: Danny Roman

Opponent party: Chris Sabian

The targeted goal of the negotiation: Roman is asking Chris to turn back on the electricity of the building, so that he could access the computer to see the files inside. In exchange, Roman is letting go of one hostage, Grant Frost, with other hostages remained being held.

The negotiator's edges and best alternatives: Roman needs the electricity to access the files on the computer that might prove his innocence. To achieve that, he needs to release a hostage to the police in exchange for the electricity, at the same time still holding the other hostages as his bargaining chips.

Timing factor involved: No.

First offer and concessions description:

Chris asked Roman to make up his mind and take the appropriate actions (surrender) quickly and that the situation was so critical that Chris was the only person in between Roman and the police forces that were going to enter the building anytime soon to take him down. Chris wanted Roman to understand that things are to be solved as soon as possible to not jeopardize everyone.

Your reflection on the negotiation process in this scene:

There needs to be an exchange of subjects of equal value when negotiations are being made. For instance, from this scene, if Roman wants the police forces to switch on back the electricity because he needs the power supply to prove he’s innocent, which is why he started this whole hostage situation in the beginning, he needs to release at least one hostage (subjects that are of value to the police).

THANK YOU FOR SMOKING

I’m referring to the scene where Nick Naylor intended to prevent Lorne Lutch from bad-mouthing on Big Tobacco.

Proponent party: NICK NAYLOR

Opponent party: LORNE LUTCH

The targetted goal of the negotiation: To persuade former “MARLBORO MAN” not to denounce Big Tobacco.

The negotiator's edges and best alternatives: Nick brought a brief case full of cash to Lorne Lutch. Nick suggested Lutch to call LA Times and CNN and approach Bonny Calrton, a reporter to talk to as well and propose Lutch either to denounce Big Tobacco and donate the blood money by forming Lorne Lutch cancer foundation or take all the monies and remain silent.

Timing factor involved: No

First offer and concessions description: Large amount of money offered to the former Marlboro Man.

Reflection: Negotiation process will be easier if the negotiator can understand the opponent’s emotions, desires and behaviors. I would say that Nick effectively manipulated Lutch to possess all the monies by increasing the temptation of his desire to own it. The persuasive approach of Nick by analyzing Lutch behavior can be illustrated when he replied to his son that; “you have to be crazy to turn down all that money”. When I saw, he wasn’t crazy, I knew he will take it”.

Secondly, the scenario where Joey convinced his mother to let him join his father’s business trip to California.

Proponent Party: Joey Naylor

Opponent Party: MOTHER (Jill Naylor)

The targeted goal of the negotiation: Joey tend to convince his mother to join the trip with his father.

The Negotiator’s edges and best alternatives: Joey tackled his mother emotionally by dragging in about her failed marriage and he also said that she is channeling her frustration on Joey.

Time factor: NO

First offer and concessions: Joey is pointing his mother weakness in making her marriage with Nick successful.

Reflection: In my opinion. I would say that no parents will try to channel their frustration on their kids, thus when Joey said that to his mother she felt guilty and coerced by the contention made by Joey. Although her marriage with Nick failed, Joey has all the rights to spend time with his father. Therefore, Joey smartly used this emotional method to persuade his mother forcibly. As I said earlier, negotiation will be easier if the negotiator manages to understand the opponent’s emotion. Desires and behaviors and manipulate it effectively.
