Legal rights of ELL students and requirements

My professional perspective will be attached to a principal's mindset with ELL students and what the law says towards these groups of students and lowering the achievement gap between this student group versus others. My field of education is Educational Leadership in hopes of becoming a principal one day. The audience being targeted for this topic will be teachers that currently have ELL students in their classroom as well as the principal. This padlet will contain information explaining ELL students rights and how principals can prevent legal measures occuring in the school by abiding by particular laws and code of ethics. I chose this topic due to the fact of the increasing number of ELL students in my area. I think everyone in Texas can agree that ELL students are increasing in number due to the influx of variations of ethnic groups from various countries around the world seeking refuge in america. 1) Can you tell me how this legal issue impacts your work?

"ELL's are the fastest growing population in Texas. So, it impacts us on a regular basis. Our district has ELL students from knowing zero English all the way to their 5th year out of the ELL program and are being monitored. This brings a challenge to the classroom when having to scaffold or differentiate the teaching/learning of the various levels of English proficiency."

2) Are there legal requirements or compliance issues you regularly monitor or have to be attentive to in this area?

- Home Language Survey
- Language Proficiency Assessment Committee
- Proper testing to be granted acceptance

"It starts with a Home Language Survey that every family must complete when enrolling. If their predominant language is something other than English spoken by the student and/or the home, then the requirements start with testing. The testing will determine along with a Language Proficiency Assessment Committee (LPAC) to determine the student's placement."

3) Are there any policies or rules you have currently written or revised related to this issue?

We do have a Bilingual/ESL written plan in place. This includes LPAC meeting and program requirements.

4) Is there current or pending legislation related to this issue? Do court cases and their decisions impact your work?

Legislation has changed the name from English Language Learners (ELL) to Emergent Bilingual (EB). Requirements have stayed the same with the addition of using LasLinks as the testing resource for the entire state to promote consistency. This could impact work significantly to provide various requirements for future EB students. The future is very unknown as to how this will change the landscape.
