         <description><![CDATA[<div>I am analyzing identify special education students from a classroom teacher perspective. As a classroom teacher for 18 years, I have worked with many special education students and some students who had not been identified yet.&nbsp; This legal guide will help guide elementary teachers in identifying students with a learning disability to help the students get the services they need. I chose this topic because I think that many students are identified with special education later than necessary in their educational journey. If classroom teachers have some guidance in the identification process, then those students can start getting the help needed early on instead of waiting. This will help those students be more successful in the classroom. According the the National Center for Learning Disabilities, 1 in 5 children with a learning disability are not identified therefore not getting the support they need to be successful in school ("Identifying Struggling Students," 2017). Students must be identified so that they can reach their full potential in the classroom.<br>Classroom teachers are tasked with teaching all students regardless of learning disabilities.&nbsp; Students must be taught in their least restrictive learning environment which is usually in the form of inclusion. Inclusion is when the special education teacher and the classroom teacher work together to meet the needs of all students in the general education classroom (Understood Team, n.d.).<br><br>References:<br>National Center for Learning Disabilities.          <description><![CDATA[<div>Jill Novak(personal communication, November 17, 2021),&nbsp; said that identification of Special Education students is essential to student growth. When students are identified early, growth for the student will be evident.&nbsp; Identification early will ensure that students get help in areas that it is needed.&nbsp; Identifying special education students is crucial to their success as a learner.&nbsp; When asked about the best practices for identifying special education students, Novak said the following:<br><br></div><div>·&nbsp; &nbsp; &nbsp; &nbsp; Documenting interventions is crucial to the identification process. This data helps make the process much easier.</div><div>·&nbsp; &nbsp; &nbsp; &nbsp; Classroom teachers must identify the strengths as well as the needs of the students to show that the student is capable of performing in the classroom.</div><div>·&nbsp; &nbsp; &nbsp; &nbsp; Identifying students early helps the students become successful early on and helps them learn the best techniques to help them grow as learners.<br><br></div><div>According to Novak, one area that educators should be aware of is the identification of dyslexia students. Dyslexia now falls under the special education umbrella. In the past, dyslexia did not fall under special education.          <description><![CDATA[<div>·&nbsp; &nbsp; &nbsp; &nbsp; In 1975, President Ford issued a signing statement that the “Education for all Handicapped Children” act would need to be revised to ensure all students were receiving the help needed to be successful. The revision of this act became the Individuals with Disabilities Act (IDEA).</div><div>·&nbsp; &nbsp; &nbsp; &nbsp; Children with disabilities are not always identified and when they are, it is not guaranteed that their needs will be met in the classroom.</div><div>·&nbsp; &nbsp; &nbsp; &nbsp; Students are not being identified correctly due to lack of funding for special education services.          <description><![CDATA[<div>The article, Evaluating School-Aged Children for Disability (2021), provides the following information to parents to help them understand the special education process.<br>·&nbsp; &nbsp; &nbsp; &nbsp; An initial evaluation happens before any special education services can be provided.</div><div>·&nbsp; &nbsp; &nbsp; &nbsp; Parents can request their child be evaluated and school districts must get parent permission before evaluating a student.</div><div>·&nbsp; &nbsp; &nbsp; &nbsp; Request from a school district to evaluate a child must be in writing in the parent’s native language, and easy to understand.          <description><![CDATA[<div>In the case of Oberti v. Board of Education of the Borough of Clementon School District (1993), the following occured:<br>·&nbsp; &nbsp; &nbsp; &nbsp; Rafeal Oberti, a student with Down’s Syndrome, was transferred to a special education class in another school district due to behavior problems in kindergarten. The current district claimed they did not have the resources to meet Rafeal’s needs, so he was transferred to a district with a classroom that could.</div><div>·&nbsp; &nbsp; &nbsp; &nbsp; Rafeal’s parents objected and initiated a lawsuit claiming the school district violated the Individuals with Disabilities Education Act of providing a least restrictive learning environment.</div><div>·&nbsp; &nbsp; &nbsp; &nbsp; The school district claimed Rafeal was not ready to be mainstreamed in a general education classroom while his parents claimed that the school district did not provide services and supplemental aids to assist him in the classroom.</div><div>·&nbsp; &nbsp; &nbsp; &nbsp; The court sided with the Oberti family and developed a two-part test to determine if a school district is in compliance with IDEA.<br><br>Reference:<br>Oberti v.
