On this side of the board I will examine how the Constitution has created a government that remains stable by preventing changes from occurring too quickly.

Popular Sovereignty: Kansas-Nebraska Act

The K-S Act was made in 1854 creating the territories Kansas and Nebraska and repealed the Missouri Compromise which allowed male settlers to choose through popular sovereignty whether they would allow slavery in that territory. This shows how we can be dynamic because we can repeal amendments that use poplar sovereignty and we can change. This type of popular sovereignty that was being used before the K-S act was a bad type so we stayed dynamic and changed it.

Limited Government: Eighth Amendment

This amendment tells the government they cant use cruel and unusual punishment. They passed this so the government couldn't torture or hang people. Mostly just so humans are treated more civilized even if they are criminals. This shows limited government, because it limited the government to only be able to use lethal injection and other less cruel ways the punish people.

Limited Government: Child Labor Amendment

This amendment was never passed but involved child labor. It would have given the government the power to regulate child labor, but the government sayed limted by not having that power. Its been pending since 1924 but has never been passed. This involves limited government because if it would have passed, then it would have given the government a power. But it didn't pass so it limits the government and keeps it stable.

Federalism: Roe vs Wade

This case was about women having the right to an abortion. They went through a whole case about when your allowed to get an abortion at each trimester it was crazy. The person who was challanging the This involves federalism because beforehand the goverment just said that you couldn't have any abortions and that was final. Then somebody challanged it and now its up to the women and the states, which gives equal power and shows federalism.

Federalism: Arizona SB 1070

This court case/ law was about how Arizona was checking for undocumented immigrants with their thoughts about how they looked. Even if they has a "suspicion" they could detain them. This was challenged by the supreme court and the supreme court stoped this part of Arizona SB 1070 so now they cant judge people on their looks. This shows stability because Arizona tried to pass it and the supreme court said nope. This means that the goveremt didn't change witch shows stability.

Separation of Powers and Checks & Balances: 2012 NFIB V Sebelius

The 2012 NFIB V Sebelius challenged ObamaCare which gives health care to people who cant afford it so they can have health care. "This lawsuit challenged ObamaCare’s requirement to have insurance and the expansion of Medicaid on a state level. The ruling allowed states to opt-out of expanding Medicaid without losing current federal funding, but confirmed that the individual mandate’s requirement to buy insurance was officially tax and therefore legal" (obamacare facts). This shows checking because the judicial branch checked the executive branch by taking it to supreme court. This shows a government that can show stability because they tried to challenge it and it didn't change a lot which shows stabilty and how it stays the same.

Separation of Powers and Checks & Balances: Watergate Scandal

This is the scandal that happened with president Nixon. He tried to steal some files from a specific place and he got away with it until they asked him for some audio files with his conversation, he said no which is the power he has which is a check/balance. But the the court overruled that because it was needed in the court case which is another check/balance. As you can see, this case contained many checks and balances so the president or the court didnt have all the power. Once they got it, Nixon resigned before they could impeach him. This shows an every changing goverment because the court was able to kick the president out of office and he couldn't control that. He tried to, be he got checked and balanced.

Popular Sovereignty: Brown vs Board of Education

Brown vs Board of Education was about how a southern state wanted the schools the be "separate but equal," and that didn't fly by the federal government, so it was challenged in court it was decided that separate but equal was unconstitutional. This shows popular sovereignty because the state used its power as a citizen to change its law (popular sovereignty). Then, the federal government showed stabiltiy by saying, "no its unlawful."
