Ontario Labour Relations Board and Dispute Resolution Methods

The OLRB uses mediation for every case they deal with. The board employs Labour Relations Specialists and Labour Relations Officers, they refer to these people as LROs. The LROs are highly educated on the Board's practices and procedure. There is an LRO assigned to every file the OLRB takes on. The LRO acts as the Board's mediator. They use only closed mediation in order to ensure that the parties involved will be more likely to share their information in the mediation. This indicates that the LRO's notes and documentation cannot be subpoenaed for any hearing that may follow the mediation. The OLRB tries to have both parties together when using mediation but often have to use shuttle or over the phone methods. The LRO acts as a common mediator and does not give either party and advice and is neutral to the issue at hand. If an agreement is made it is put into writing and often incorporated into a Board decision. Once the agreement is made the conflict is terminated. If an agreement is not made the matter will be scheduled for a hearing.
