         <description><![CDATA[<div>MOEDERSCHAPSVERLOF (Maternity leave)<br><br>Maternity leave for employees<br><br>If you are going to give birth, you are entitled to&nbsp;15 weeks of maternity leave&nbsp;.&nbsp;Maternity leave consists of two parts:<br><br>Before birth (&nbsp;'maternity leave')&nbsp;: maximum&nbsp;6 weeks&nbsp;(of which 1 week is compulsory)<br><br>After birth (&nbsp;'maternity leave'&nbsp;or 'maternity leave'): at least&nbsp;9 weeks&nbsp;(mandatory).<br><br>You are no longer allowed to work one week before the expected delivery date.&nbsp;The remaining weeks (antenatal) maternity leave (up to 5 weeks so) you may&nbsp;transfer&nbsp;to the (postnatal) maternity leave.&nbsp;As a result, the postnatal leave can be a maximum of 14 weeks.&nbsp;The postnatal rest can also be extended by the duration that the newborn child remains in hospital after the first 7 days from birth (maximum 24 weeks).<br>If you are&nbsp;expecting&nbsp;multiple births&nbsp;, the maternity leave will last 17 weeks, but this can be extended to 19 weeks.<br><br>Before birth (maternity leave): maximum 8 weeks (of which 1 week is compulsory)<br><br>After birth (maternity rest or maternity leave): at least 9 weeks (mandatory).<br><br>Inform yourself thoroughly about your rights and obligations with your employer's personnel department, your trade union or your health insurance fund.<br>You are also&nbsp;entitled to leave&nbsp;if you&nbsp;adopt&nbsp;a child&nbsp;.&nbsp;That is called&nbsp;adoption leave&nbsp;.<br><br>Maternity leave for the self-employed<br><br>If you are going to give birth, you are entitled to&nbsp;12 weeks of maternity leave&nbsp;.&nbsp;Maternity leave consists of two parts:<br><br>Before birth (&nbsp;'maternity leave')&nbsp;: a maximum of&nbsp;3 weeks&nbsp;(of which 1 week must be taken)<br><br>After birth (&nbsp;'maternity leave'&nbsp;or 'maternity leave'): at least&nbsp;9 weeks&nbsp;(of which 2 weeks must be taken).<br><br>If you are&nbsp;expecting&nbsp;multiple births&nbsp;, the maternity leave will last 13 weeks.<br>You do not have to take the non-compulsory weeks consecutively.&nbsp;You can take this according to your own choice from 3 weeks before the delivery to 38 weeks after the birth, in periods of 7 calendar days.&nbsp;As a self-employed person, you can also take the non-compulsory weeks part-time.<br><br>Maternity protection<br><br>Motherhood should not give rise to&nbsp;discrimination&nbsp;.&nbsp;Also during job interviews, an employer is in principle not allowed to ask questions about any pregnancy plans, unless those questions are relevant due to the nature of the work.<br><br>As soon as you are pregnant, it is in every interest to&nbsp;inform your employer&nbsp;.&nbsp;You do this by sending a medical certificate by registered mail or by handing it over and requesting a receipt.&nbsp;From that moment on, a number of legal protection measures come into effect.&nbsp;For example, you may be absent from work for a pregnancy test if this cannot take place outside working hours.<br><br>From that moment on you are also&nbsp;protected against dismissal&nbsp;.&nbsp;This protection against dismissal runs up to one month after the postnatal leave (including extensions).<br><br>Pregnant and breastfeeding workers&nbsp;are not allowed to work overtime&nbsp;.&nbsp;There are exceptions to this rule, for example for persons with a position of trust or persons with a managerial position.&nbsp;Nor can the employer oblige a pregnant employee&nbsp;to perform&nbsp;night&nbsp;work during a period of eight weeks before the expected date of delivery.<br><br>If you are pregnant, have just given birth and / or are breastfeeding, you may not work in labor posts or production units where you or your child run a&nbsp;health risk&nbsp;.&nbsp;In that case, your employer must adjust your working conditions or propose a modified position.&nbsp;If that is not possible, the&nbsp;prevention advisor-occupational physician may&nbsp;decide that you&nbsp;must temporarily stop working&nbsp;.&nbsp;In the event of such a total or partial&nbsp;deletion of&nbsp;(in case of complete work stoppage, this is also referred to as 'preventive leave' or 'prophylactic leave'), you can claim a benefit from the health insurance fund that covers your loss of wages.<br>To be entitled to maternity leave, you must meet the following administrative obligations:<br><br>you have completed a professional integration period of six months, or you are exempt from this waiting period;<br><br>you are an employee or unemployed person and have worked (or are looking for a job) for 120 days in the six months prior to your maternity leave;<br><br>you have paid a minimum amount of social security contributions;<br><br>there is no interruption of more than thirty days between the start date of your maternity leave and your last working day (or day of unemployment).<br><br>With the exception of the condition relating to the professional integration time, these are the same administrative conditions as those that apply to disability benefits.<br><br>What am I entitled to and how do I apply for the benefit?<br>The amount of the maternity benefit depends on your status (salaried employee, unemployed or self-employed) and your income.<br>If you are an&nbsp;employee,&nbsp;the maternity benefit amounts to:<br><br>82% of the unlimited salary during the first 30 days;<br><br>75% of the capped salary from the 31st day;<br><br>Maximum: € 110.23 per day from January 1, 2019.<br><br>If you are&nbsp;unemployed&nbsp;, the maternity&nbsp;benefit&nbsp;on 1 March 2020 will be:<br><br>a basic benefit equal to the amount of your unemployment benefit + a supplement of 19.5% of the gross salary, limited to € 116.85, during the first 30 days;<br><br>a basic benefit equal to the amount of your unemployment benefit + a supplement of 15% of the capped gross salary;<br><br>€ 110.23 after the 31st day.<br><br>If you are&nbsp;self-employed,&nbsp;the maternity benefit is a fixed amount per week.&nbsp;The sum is determined on the benefit that applied on the first day of your maternity leave.&nbsp;On 1 March 2020, the amount of the maternity benefit per week is set at € 499.54 for full-time and € 249.77 for half-time maternity leave.<br>Maternity benefits are paid by the health insurance fund.&nbsp;To claim maternity benefit, submit an application to your health insurance fund together with a medical          <description><![CDATA[<div><br>if you work for a <strong>private sector </strong>employer, you can interrupt all or part of your performance through time credit for one of the regulatorily determined motives. These motives are: 'caring for his child under the age of 8', 'caring for or assisting his seriously ill minor child', 'caring for his disabled child under the age of 21', 'caring for or assisting a seriously ill family member', 'providing palliative care to someone with an incurable disease, who is terminal' or 'in a recognized education'.<br><br></div><div>For the motives 'care' you can obtain a complete interruption or a partial interruption up to half or with 1/5 for a maximum of 51 months. For the motive 'training', this duration is a maximum of 36 months. During the time credit with motive, the RVA can grant you a monthly benefit, as a replacement income. The amount of that benefit shall be flat-rate.<br><br></div><div>Plus, from the age of 55, you can also get time credit, which allows you to reduce your performance by half or by 1/5 until retirement. No motive is required for the time credit runway. You must have at least 25 years of professional history as an employed person for this. During the time credit runway, the RVA can grant you a monthly break allowance if you reach the age of 60. Exceptionally, you can be granted that benefit from the age of 55 if you meet one of the different conditions in the regulations (e.g. having at least 35 years of professional history as an employed person or having exercised a heavy occupation). This applies to both employees and the self-employed. <br><br><strong>Employees:</strong><br>You have as a father or as co-parent <br>(open definition)right to 15 working days of maternity leave if the child was born since 1 January 2021.<br><br>The same term applies in case of multiple births.<br>You must take this leave within 4 months from the day of the delivery.<br>Those 15 days may be taken in one go or spread out.<br>During the first three days of the maternity leave, you will receive your full salary from your employer. Generally for white collar workers they get Saturdays and Sundays off but blue collar/shift workers might get an Sunday and Monday off depending on the shifts they work. Employees are also entitled to Bank Holidays as days off but if your sector/industry require you to work on these bank holidays you are entitled to either time off or overtime paid.</div>]]></description>
