Legislative Power

There are three branches of government to balance power. The leader is the House of Representatives and and Senate. The House of Representatives are based upon each states population. Each representative is elected for two years. The representatives have to be a citizen for seven years, and have to be at least 25 years old. The Senate on the other hand has two people representing each state no matter the population. A Senator is elected for six years. The Senator needs to be 30 years old, and needs to be a citizen for nine years. I a bill needs to be passed they need to vote on it. If the president vetoes the bill the congress would need 2/3 of the votes to pass the bill. This ensures that the president does not have to much power, and also ensures that the Congress does not have too much power.

Executive Power

The leader of the executive branch is the president. The president has many powers, but they are kept in check. He can sign a bill from congress into law or to veto it. The President also appoints leaders of department and agencies. The President plays a very important role as he has to sign treaties, and keep diplomacy with other nations. The President needs to be at least 35 years old, and has to be a citizen for at least 14 years. The Vice President is second in line to being President. The Vice President also breaks ties in the Senate. The Executive Office for President or EOP helps the President. Then last of all there is a cabinet which are the 15 heads of the departments approved by the Senate.

Judicial Power

The Judicial branch consists of Judges and Courts. Federal judges are not elected but appointed by President and approved by Senate, they are appointed for life. The Judicial branch interpret the laws of the Congress, they do not make laws. The Supreme Court is the highest court in America. The Supreme Courts consist of six judges. According to the Constitution everybody has the right to a speedy trial. First the criminal plea’s guilty or non-guilty. Then with a lawyer they go to court and the judge determines if they are guilty or non-guilty. If one side does not like the decision they can take it to the higher court.

State’s Powers and Limits

States cannot form alliances with foreign governments. States do have the power to have the power to create or enforce laws. Each state must respect the laws and court decisions. Extradition is when a criminal from one state runs to another one. Then states can request the other state to put the criminal in jail in their own state. New states church be admitted through union with the permission of the President and the Congress. All states in the USA must have a representative and a government to be apart of the United States of America.

Amending the Constitution

The Constitution is never final and the framers of the Constitution wanted the ability for people to change the government. A change or a replacement to the government is called an Amendment. You might think it is very easy to get an amendment passed, but it is a lot more difficult than you think. This was because the founders of the Constitution were scared that people were going to misuse the power of amendments. Right after the constitution was passed two years later the Bill of Rights was passed. The Bill of Rights were the first ten amendments for the Constitution. Overall it is very difficult to get an amendment passed. The good news though is that an ordinary person can raise an amendment.

Federal Law

Federal Law can also be called federalism. Federal Law means that the National power is shared with the states. If somehow a state and a federal law disagrees the federal law would win over the state. Though both sides need to take an oath to defend the constitution. This oath can never be broken.

Bill of Rights Part One

We as the people find something wrong about the Constitution as they are some holes in it. These are the ten things we hope get passed as amendments, and we will call the Bill of Rights.

Protect the freedom of the people, also being able to petition the constitution.
The right to bear arms.
Prevents the Government from placing troops in private homes.
No unreasonable search or seizures, a warrant is necessary, and a warrant needs a probable cause.
Provides the right to not testify against oneself in court, also cannot be charged for the same crime twice.

Assures speedy trial by jury of peers; right to confront witnesses; must be informed of crime.
The right to a trial by jury
Prohibits excess bail, fines, and cruel or unusual punishments.
Not all rights are listed in the constitution.
Power is not granted to the federal government, it belongs to the states and the people.
