In my review of the NASB website, I found there to be legal and ethical issues in student rights and discipline. There are many challenges in maintaining balance in the classroom while upholding the rights of the students. The First, Fourth, and Fifth Amendment rights protect students as educators try to keep safety and a peaceful learning environment a priority.

NASB also explores the legal and ethical issue of privacy and technology. Schools are required to keep student data private and the website has information on laws such as the Family Education Rights and Privacy Act (FERPA).

This website discussed the work that is being done for the Every Student Succeeds Act (ESSA). With the implementation of ESSA test scores are not the only way of seeing the success of students. There are many aspects to student and school success beyond math and reading test scores.

Achievement gaps were also discussed as a legal and ethical issue in schools today. The NEA website includes a handbook on the impact of poverty on students learning. There is also information on the 2011 C.A.R.E Guide for strategies to close the achievement gaps.

This book interest me on the topic of due process rights for students. When it comes to due process for students the state must have taken an action, which takes away from the student life, liberty or property. If a student is suspended for a period of time they are legally authorized a due process from the public school system.

Another legal and ethical issue discussed in the book was students with disabilities. The educating of students with disabilities is upheld with the passing of IDEA which notes students with disabilities should be in the least restrictive environment.

Summary of Due Process for Students

This topic is very important for educators because it is an ethical issue on fairness. When students are suspended it should be based on equality and should be uniform for all. Teachers and administrators must not bring personal bias into discipling students. If a student and parent feel they have not been given fair warning or treatment they are due a process that allows them to be heard.

Special education students are also very important in this legal issue. Teachers must be aware of their personal bias in teaching these students. Inclusion of special education students and them being taught the same curriculum as general education students is a big part of due process for students. This will be an important message I will convey to teachers and administrators in my career as a curriculum and instructional specialist.
