An app designed to collect data on the number of cars in the streets. It will display available parking spots, making it easier for drivers to find a place to park. In Sydney, there are around 12 cameras for every 1,000 people. These cameras could be used to gather city data and record the average number of cars present in the city center each day.

In Australia, the collection and use of personal data for commercial purposes is mainly regulated by the Privacy Act 1988, overseen by the Office of the Australian Information Commissioner (OAIC).

It applies to:

• Most organizations with an annual turnover above AUD 3 million.

• Some smaller organizations if they handle sensitive data, provide health services, or trade in personal information.

The Act covers personal information, meaning any data that can reasonably identify an individual (name, email, phone number, IP address, biometric data, etc.).

📌 2. Australian Privacy Principles (APPs)

There are 13 APPs (Australian Privacy Principles) that guide how personal information must be collected, used, stored, and disclosed. Key rules for commercial use:

• APP 1: Open and transparent management → organizations must have a clear, accessible privacy policy.

• APP 3: Collection → collect only information that is reasonably necessary for your business purposes.

• APP 5: Notification → individuals must be informed at the time of collection (who is collecting, why, and how the data will be used/disclosed).

• APP 6: Use and disclosure → data can only be used for the stated purpose, unless the individual consents to a different use.

• APP 7: Direct marketing → allowed only if:

  • the individual has consented, or

  • there is an existing relationship and the individual would reasonably expect marketing, and

  • every message provides a simple way to opt out.

• APP 8: Cross-border disclosure → if data is transferred outside Australia, the organization must ensure the overseas recipient provides equivalent protections.

• APP 11: Security → data must be protected from misuse, loss, unauthorized access or disclosure.

• APP 12 & 13: Access and correction → individuals have the right to access their data and request corrections.

📌 3. Consent & Marketing Rules

• Consent must be voluntary, informed, current, and specific.

• Spam Act 2003: prohibits sending commercial electronic messages (email, SMS, social media) without prior consent. Every message must:

  • clearly identify the sender,

  • include a working unsubscribe link.

• Cookies and tracking: not as strictly regulated as in Europe (GDPR), but the OAIC expects transparency and informed user consent, especially for advertising and profiling.
