Cesare Beccaria anonymously writes his first essay "Dei delitli e delle pene" at the age of 26. In his essay he talks about cruelty of the establishments of criminal justice. "The essay was a tightly reasoned devastating attack upon the prevailing systems for the administration of criminal justice. As such it aroused the hostility and resistence of those who stood to gain by the perpetuation of the barbaric and archaic penological institutions of the day."

Beccaria came to the belief that not much had changed in the way of criminal practices after his essay 'on Crime and Punishment was created. This made him come to the realisation that most countries under a monarchy maintained the thought a crime is a sin purely due to some of their religious beliefs that people who commit crimes are possessed by the devil or evil demonic forces. This was the sole reason as to why using torture in order to get criminals to confess their sins was upheld.

Beccaria believed that the main way that the criminal justice system—a central part of the law—contributes to the happiness of the members of society is by reducing the amount of crime. Criminal acts, they believed, tend to cause harm and thus reduce the amount of happiness in society. Therefore, if punishments reduce the amount of crime they increase the amount of happiness.
