         <description><![CDATA[<div>Mr John talk about seek for assistance from IUF regarding the issue on recognition by Club Med in Kuala Lumpur to the union. This is because the issue on recognition has pending for 12 years. In my opinion, union should pass the issue to the Department of Industrial Relations. The department will determine whether majority of the workers are union members or not by secret ballot. If employer not granted recognition after outcome of the membership check, Director General of Industrial Relation will report the matter to the Minister of Human Resource. Minister will order recognition if more than 50% of the workers belong to union. For the employer perspective, recognition will result the collective bargaining. It will higher the cost for employer by increase the wages and benefits of workers.</div>]]></description>

         <description><![CDATA[<div>From my observation, Mr John, General Secretary of NUHBRW explained about the status of Club Med as a trade union which not being recognized within 12 years. In addition, he talks about the role of IUF in the NUHBRW which has win the union recognition for the members. Mr John has mentioned the Club Med that challenged in industrial court. But they lose the case then, they bring it in court of appeal. As the consequences, Club Med did not get a hotel that they deserve because the trade recognition still in process. Despite of that, the implication of secret ballot delay the process of trade recognition. </div>]]></description>

         <description><![CDATA[<div> </div><div>In my opinion, Club Med Malaysia, did not want to recognise the union because they do not like the demand of the union, and refuse to work with third party. As for the employees, they want their right to protected, which is the main purpose of this union. In Malaysia, it is okay for employees or employers to form a union as long as they are separated from each other. Other than that, employers do not have the right to stop any of their workers to join a union or to form a union. This is quite unfair to the employees because Club Med is not a small company, the employees there might felt the injustice n their employment contract and need someone to represent them to the collective bargaining and collective agreement. This case have been thru many procedure that is time consuming and costly, this is not good for the company. Because until now they still did not recognise the union. In the video, John Angelus mentioned that they are currently having a collective agreement at industrial court level. This means that they no longer refuse to recognise the union, but both parties are in conflict with rules and demand from both parties.          <description><![CDATA[<div>NUHBRW of Malaysia (General Secretary John Angelus of Club Med has stated that they failed to get recognition for their trade union.<br>&nbsp;<br>Although,after attempts by management to refuse to recognize NUHBRW as the union representing Cherating employees, attempts which failed thanks to legal action taken by the Union and the two parties opened negotiations on a collective agreement, which are deadlocked due to the compensation issue.Management wants to implement a bonus system based on occupancy of the village (occupancy allowance - OA) while the Union does not accept that Club Med put a threat through the OA the system prevailing in the whole of hotels and tourism establishments, namely the perception and the distribution of service charge added to clients’ invoices, whose purpose is to ensure the remuneration of staff.<br><br>Because of the stubborn refusal of the management to listen to the union’s arguments, negotiations on a collective agreement are blocked, although both parties do agree with almost all of the provisions of the agreement, with the exception of compensation.&nbsp;<br><br>In my opinions, the club med should reconsider the occupancy allowance and should listen to the union .Then, the club med should wait a further six months before making another request and any other attempt to get recognition. Then wait for the decision of the Mohr. The decision of the Minister is final and shall not be questioned in any court of law.&nbsp;</div>]]></description>

         <description><![CDATA[<div>According to Mr. John, who is a General Secretary NUHBRW says about the status of Club Med which has not being recognized for almost 12 years.&nbsp; This is because they do not like the request of the union and reluctant to work with other party. &nbsp;<br><br>Therefore, The ClubMed has opposed the rights that should be given to the workers.&nbsp; Anyhow, as an employee who has worked hard for the organization, has their right to protect right to be protected, in which that is the main factors of the union.&nbsp;<br><br>In our country, Malaysia, it is legal for employees to form a union&nbsp; to voice out their rights and opinions as long as they are separated from each other.&nbsp; It is unfair for the employers to not give the recognition even after the union has been made. &nbsp;<br><br>Apart from that, this case has went through many procedures that is quite costly and time consuming. &nbsp;<br><br>The implication of the secret ballot delayed the process of trade recognition.&nbsp; In this video, John Angelus has stated that they are currently facing a collective agreement at the Industrial Court.&nbsp; This means that they are no longer reject to recognise the union. &nbsp;<br><br>Because of the refusal of the management to listen to the union's arguments, negotiations on the collective agreement have been blocked.&nbsp; Although both parties have agreed with almost all of the provisions&nbsp; of the agreement. &nbsp;<br><br>Lastly, the ClubMed should deliberate the occupancy allowance and should listen to the union and must wait for 6 months. &nbsp;<br><br>-Nur Alqashash Mohamad<br><br></div>]]></description>

They have been asking for recognition for 12 years from Club Med. John also mention that secret ballot is not relevant method anymore because its time consuming. By that time, most of the workers will probably resigned from their jobs and the organization will lack of workers to participate in the secret ballot. He say that Club Med did not honoring the fundamental of human rights and they want to fights for their right. Mr. John talks about the opposition of Club Med to recognizing a trade union at a hotel in Malaysia and the role of the IUF in the NUHBRW. He stated that they already submitted the claim for recognition for 12 years but unfortunately the club med did not give the recognition. After address the matter in IUF at Guinevere, finally they had a good new that the club med is agree to not persuade to this matter. The hotel is preferred to use the secret ballot but it will take a long time to conduct the secret ballet. And because of that happened most of the employee left the hotel and they will not have enough employees to the secret ballet.  <br><br></div><div>In my opinion, Mr. John seeks for the help to recognize the union. Employees have a right to whether to join the union or which union they want to join as long as the union follows the law.  In my opinion, the employer did not recognize the employee union it is because the union bargaining is high, it also will limited the power of the management to run their organization, and the production of the organization might need to be stop.  <br><br></div>]]></description>

Trade union have spent hundred thousands for the legal matters, while Club Med didnt pay any. Therefore, the Union asks Club Med to pay. Now this is the part that shows how the Union plays their role to protect their employees by having collective bargaining in order to create a peaceful relationship between both parties. In the perspective of employer, they should not stop their employees to claim their rights through Union. In this case, the purpose of the collective bargaining is to get the recognition. It is legal. Until the case ends, the Union should continue protecting the employees in this issue. </div>]]></description>

The reason why Club Med did not want to give recognition is because there are not enough workforce who is in the scope to participate in the ballot at the time of the claim. From this issue, i think that both parties need to do negotiation process in order satisfied each other needs and rights. The employees submitted a claim for the recognition because they want their right to be protected. The reason why employees decoded to form this union because they are not satisfied with terms and conditions of the employment. Because if they were satisfied with the terms and conditions, they would not wasted their time waiting the recognition for years. Referring to what i have learned in class, workers have right not to join or join a trade union. This situation is unfair for the employees as they seems been forced to not joining the trade union that they have been submitted for years until they have to go through many procedure in court of  law which is costly.          <description><![CDATA[<div>&nbsp;</div><div>John angelus of the IUF-affiliated National Union of Hotel, Bar and Restaurant Workers (NUHBRW) of Malaysia. John talks about the opposition of Club Med to recognizing a trade union at a hotel in Malaysia and the role of the IUF in the NUHBRW finally winning union recognition for their members. In my opinion, as the employees, they had the right to form a union as to protect their right as employees. As employers, they do not have right to stop any of their workers to join a union or to form a union. This is quite unfair to the employees, because there might felt the injustice and their employment contract. This case have been through many procedure that is time consuming and costly, this is not good for the company as they still did not recognize the union. Lastly, the Club Med should deliberate the occupancy allowance and should listen to the union and must wait for 6 months.&nbsp;</div>]]></description>
