The police questioned Scott Sornberger, a former client of the bank, and his wife Teresa. Scott was 5'11", had blond hair, blue eyes, and a mustache. They both had alibis, which was that they were both at Scott's parents' house, using his parents' computer, but the police continued to question them despite the fact that there was a recognizable difference between Scott's face and the bank teller's description of the robber. The Sornbergers' had financial problems and had a closed account at First Bank.

The police got a search warrant to search Scott's parents' house to confirm the couple's alibi. They searched the computer, but an officer, Officer Clauge, expressed what he believed was true to State's Attorney Mangieri. He said that the man in the surveillance video looked so similar to Scott. He also told him about the Sornbergers' financial problems. This was probable cause, but the officers decided to make the arrest during the execution of the search warrant for Scott's parents' computer, but they also wanted to re-interview Teresa when she was home.

The Sornbergers spent only 4 months in jail and they also claimed for an unlawful arrest.Teresa was never a suspect of the crime so she had no right to be accused of robbing the bank. Also, the robberies continued in the area while the couple were in jail. The man that was robbing the banks did indeed resemble Scott, the man that was securely locked up. Scott and Teresa finally became free and took back custody of their children.
