Juvenile Justice Activity 1 (Period 6) by Jaymee Orafferty

If you committed a serious crime (like murder, rape, etc.), do you think it would be fair for you to be punished the same way an adult who committed the same crime would be? Why or why not? Would your reasoning apply to all crimes or just certain ones? Does age make a difference (would a 12-year-old get the same sentence as a 17-year-old)? Even if you believe teens/children should get the same treatment by crime, would the punishment the same or should it be different? How?

I think that intent matters a lot when considering the punishment of the crime, As well as the mental state of the alleged party.Historically speaking though, children found guilty of crimes have not always got the most fair punishment. That being said the age of the guilty party is and important factor because with crimes like murder, because depending on the age of the child it is unclear whether that understand the weight of their crimes or even have a similar level of rationale as somebody who's older.

I think older teenagers should get punished the same as an adult because as a teenager you are more developed as a person and know what you are doing but as a kid not as much. The reason being that they can be lost or not disciplined as well. It should apply to almost all crimes. When it comes to a 12 and 17 year old that is 5 years apart and in those 5 years you start to realize more things and see things with more understanding and that adds more as to why younger kids should still receive punishment just not as vial. It should be dimmed down a bit so they can still get disciplined and get what they deserve but also not traumatize them since they are still kids and can still change if steered in the right direction.

If I committed a serious crime as a minor I do think it would be fair to punish me the same way an adult would be. If I was able to actually go through and do that terrible thing I think I should be treated just as equal. I don't think that there should be any exceptions, I think you should be tried as an adult. I do not think age makes a difference because even if you are 12 you still know what you are doing.

If I committed a serious crime as a minor I feel it would be fair to be punished the same way as an adult who committed the same crime because one should know right from wrong at an early age. "Not knowing any better" isn't an excuse you should be aware whether your actions are going to hurt someone or not. If one thought they were old enough to commit such crimes, they're old enough to receive the punishment that comes with it.

I think that no matter the age, people should be punished for crimes that they commit. No, they shouldn't be punished the same way as adults, but there needs to be that line for everybody. There should be some thought into it. Things like age, mental health, etc. should be taken into account when dealing with minors. But you can't just completely neglect the fact that they committed a crime. For more serious crimes, it shouldn't be taken lightly even if they are young. But I don't think that their lives should be completely ruined over something small.

If I committed a serious crime, I think it would be fair if they trialed me as an adult sense I am close to the age of being an adult. This would personally apply to all crimes that I "would do". Age does make a difference, since a kid of 12 years of age would not be the same as a 17 year old, since they don't know right or wrong yet. They should get the same treatment as they are criminals, but they should be punished a little less harsh as adults, because they are simply kids, but are still criminals who did bad things.

I think that would depend on age. Adults are already people who are aware of what they do or think, minors are still at a stage where they can be easily influenced by other people. It would also depend on the crime, it depends on what type of crime the person committed, some crimes such as death can be treated with the same justice at all ages, since it is taking a life, it does not matter if the person who did it is a person aware of what he did or did not do. As I mentioned before, age does matter as well as the crime, since a 12 year old person does not have the same reasoning and maturity as a 17 year old person, this matters in how the punishment would be carried out. Punishment should be treated depending on age in most crimes, but in major crimes, it should be treated equally at all ages.

If I commited a serious crime, it would be only fair for the same way an adult to be punished if and what the serious crime was. Looking at what "I" did was a crime that would possibly happen again can be dangerous for everyone. A minor causing a serious crime and an adult doing the same thing the punishment should be the same, age is just a number. Minors do have more time to do for life sentence because adults have a lesser chance of doing life sentence for the crime they did. Looking into minors or adults motive can tell you whether or not the crime can happen again. But at the end you never know what caused the minor or the adult to commit the crime because everyone has their differences.

When younger people commit serious crimes they might see it as a joke and think they wouldn't have to deal with serious consequences. Getting the same punishments as adults should teach them a lesson how the consequences for serious actions can really affect them. Could also teach them a life lesson about not everything is a joke.

Yosselene I don't think it would be fair to punish a child to the same severity that you would punish an adult. I do think the stage of childhood that you're in matters though. There are kids, tweens, and teens. I think if any of these were to commit a crime like murder, they should be punished depending on the severity of the situation and if they were aware of what they were doing and the consequences that would follow. Like if a 17-year-old committed the same crime as a 9-year-old, I think the 17-year-old should be punished more harshly because a 9-year-old doesn't know as much as a 17-year-old does. I think the maturity level matters as well. Just because someone is older doesn't automatically mean that they know more or know better. I think there are too many factors to consider because each situation is different.

Age makes a difference because when we are young we make the worst decisions. The frontal lobe, which is the decision making part of the brain does not develop until around 25 years of age. Things that we also need to keep in mind are the person's life experience, and their mental state. People under the age of 18 should be provided assistance while still facing punishent. - Itzel Suarez Baez

Unless the teen/child is mentally unstable then their punishment could be less or none depending on how serious the illness is, or crime. Also I believe that those who are aged 12 and up should be punished as adults because at that age the child is able to process and make their own decisions. In the end they are still criminals just like the adults who committed the same type of crime.

I think it would depend on the age and the crime to decide on what the punishment would be. Age matters because a 10 year old has a different mindset as a 17 year old. Usually crime happens from curiosity, hate on someone or most likely could be mentally illness. In this case most crimes for youth are passed as not guilty. As an adult, the mindset is stronger than a youth mind which is more accurate in why they committed the crime. As in more into others point of view most youth crimes are similar to adults crimes and most punishments the same.

It would not be fair to charge a minor that still relies on their guardian, the same as an adult that is an independent member of society. This reasoning would apply to all crimes that are not planned out. The prison system if anything teaches people about how to commit crimes more than helps reform. Children should get a punishment that doesn't derail their life and education completely like serving on the weekends like you can do with certain crimes. Teens are more developed where they know the magnitude of crimes better. So they should be charged closer to adults but still with more mercy than an adult.

On the other hand if the crime was committed with malicious intent and the juveniles understood the consequences of their actions then they should be held accountable in a similar manner as an adult.

Things to consider are not the age but the crime committed, the mental state of the person and if the crime was done out of self-defense. Age should be taken into consideration for lighter crimes but for larger crimes given the circumstances and the severity of the situation, it should not. Harmful crimes are never justified but the story behind the crimes should be taken into effect and consideration.

I do believe that all people should get the same punishment for most crimes, but I also think that this should only be for violent crimes only, like murder, assault, 🤬, etc. You shouldn't get special treatment because you are a minor, you still have control over your actions. Although, I do believe there is an argument that if it was an accident, like in the cases of 3rd degree murder, there could be some leniency on the charges and sentences. There is also arguments to how young of an age this should apply to, but I don't think this matters because if a 10 year old killed or raped someone with intent, I think they should be sent to prison. When I look at this from a much deeper POV though, I can see where this can affect marginalized communities much harsher. With the systemic oppression in our country still very evident, I can see where children in marginalized communities would have much higher arrest rates and worse sentences than middle or upper class communities because many studies have found that racial and ethnic minorities are given harsher sentences.

I think that when it comes to serious crimes, juveniles up to a certain age should be punished the same way as an adult who committed a serious crime. Juveniles understand that serious crimes like murder are something that you shouldn't do. The context of the crime matters which is why I think juveniles maybe under 14 or 15 should receive lighter sentences depending on the situation as they could have made a dumb mistake or decision such as negligence that can lead to something bad happening.

I think in most circumstances it definitely would be fair because serious crimes should have serious consequences. Although I believe any serious crime that involves harm to others in any way or form should have serious punishments, I do believe that age would be a factor because adults (any age) and teens (including preteens) have much more knowledge than a child under the age of 10. Depending on the crime committed, I do think a 12 year old and 17 year old should have similar consequences. I also believe if teens and children have easier or simpler consequences than adults, this will only have them think the crimes being committed aren't as "bad" because they're young.

If I commited a crime as a minor yes, it would be fair to be punish as a adult because either way I committed the same crime. I say the age doesn't matter because at the age of 12 and up they should know what is wrong and what isn't. They should have a mature mindset and know what is going through their head. They know what they did and should be charge as an adult.

I do think it would be fair to be punished the same way as an adult. At the age of 17 our brain is well developed and you should know not to commit crimes. At the age of 12 brains are not well developed but there should be consequences. I do think their home situations should be checked to see why things were committed. The type of crime committed should matter when being charged.

I do not think it would be fair for a minor to be charged the same way an adult would be. As a minor, I think the punishments should be significantly different because of the effect it would have mentally and physically. Also considering the circumstances of these crimes, it all depends on the severity and reasoning behind everything.

In my opinion serious crimes should be charged the same no matter the age. If the crime is not that serious and was done on accident, the different age should be punished at different levels in which kids are lighter punishment then people 17+ of age due to them knowing what they are doing and consequences that they are put on. I believe everyone should get punish on any crime to an extend depending On their age. The higher the age the higher the punishment should be.

In my opinion, I believe a harsh punishment is needed if you murder or 🤬, someone if not the penalty of death no matter the age. I believe minors depending on the crime should be charged as adults. But first, I believe that the punishment should match the crime. If a teenager goes out and vandalizes property, I believe they should be forced to do community service to clean up the vandalism they did. But I believe crimes like robbing, stealing, or assault should be phased with adult consequences, so it really depends on the crime that has been committed.

If I were to commit a serious crime I believe I should be given the same sentence as an adult. I am old enough to know my right from wrong, so I am old enough to face the consequences for my actions. I feel that kids that are 12 and under should get some wiggle room depending on the severity of the crime. This is because sometimes kids actions can still be corrected after giving them a taste of what life could be if they don't change.
