This is part of founding fathers' desires to have a government that tolerates dissent. One's freedom of speech and freedom of expression would be much more limited without this right. The founding fathers wanted to have a government that tolerated dissent to prevent emulation of European governments that often had violent conflict, stagnant politics, and governments with too much power.

This case was argued on December 16, 1962 and was decided on February 25, 1963.
In order to fight against the segregation in their state 187 petitioners decided to have a peaceful protest and march down to the South Carolina State House grounds. As the members of the protest marched through neighborhoods, without causing chaos or blocking traffic, they were met by the police force. The protesters were told to stop the protest but they did not follow the commands as they stood their ground and sang patriotic and religious songs. As a result they were arrested and later convicted on a charge of breach of the peace. The court decided to keep the chargers and declared that the protest was violent, one of the judges went against them and said that they were exercising their first amendment right.

De Jonge gathered a group of around 300 people publicly and taught communist doctrine to them. Although communist doctrine is against the US government and even advocates for the violent overthrow of leaders, this protest was peaceful. Due to this, the Supreme Court upheld De Jonge's actions and reversed the decision to persecute him for this protest.
