The things that I learned in this class is I found out that the procedure in court are conduct in different ways based on the case, for example, Mahkamah Adat are only conduct about the customary laws and as well to another courts.
Secondly, I learned on how to argue with case when have the evidence and the act. For example, the case about the rape can used on Seksyen 376 Kanun Keseksaan, and the case about the SOSMA Act 2012 for national security.
Thirdly, I learn on how the legal system in Malaysia works based on different field.

i have learn about precedent and stare decisis. Precedent is a judicial decision. A doctrine that requires a judge, in resolving a particular case, to follow the decision in a previous case, where the fact situations in the two cases are similar. Important when dealing with same set of facts.

In this course, I have learn about the important of judiciary institution to defend the right of Malaysian.

Between 2007 and 2008, there are rumor our land will be taken by the state government. Btw, it not a rumor but its true. The villager panic. They report it to the YB but nothing has been done by the YB. Soon after that, by the help of the intellectual/scholar (born and rise in my village) plan a strategy to hire a lawyer to fight back against the government. They collect all the evidence, record a statement from the older generation (witness), take a photo of hundred years old durian tree, and other.

Luckily, we win the case. Thanks to the judiciary body that has been successful done their job.

From this course, I have gain knowledge about institute of law in malaysia. There are at courts in Malaysia with their own ranking. The highest court with high power in Malaysia is Federal Court that can overwrite an appeal case from lower court. The second highest court is court of appeal which determine appeals arrising from decisions of a High court. Then the ranking is followed by High Court in Malay, Sabah and Sarawak that held unlimited juridiction in civil and criminal cases and hear appeals from subordinate courts. Next is followed by Session Court, majistrate court and penghulu court.

Because of this lesson, i have caught a glimpse of law especially the term of stare decisis.

My view that, Malaysian Legal System is one of the best Course to learn deeper regarding judiciary. I learned about how courts procedure decide either he or she found guilty. Act was enacted to determine the type of offense but there is also case no need to be resolved by the Act as for example Torts Law. It entails a reference from old case to confirm either convicted or not.
