         <description><![CDATA[<div>Mediation is increasingly formal yet at the same time leaves control of the result to the gatherings. An unprejudiced middle person causes the gatherings attempt to arrive at a commonly worthy goals to the question. The gatherings control the substance of the conversations and any understanding came to. An average meeting begins with each gathering recounting to their story. The middle person tunes in and causes them recognize the issues in the contest, offering alternatives for goals and helping them in creating a settlement.</div><div>I would prefer this method over the other two methods because with one both parties to get to have there say so in the decision making, you are directly involved , meaning they’ll get a settlement that both are fine with. </div><div>This process is also private so if emotions arise or gets out of hand from either parties he mediator is they’re to calm both parties. They can do help with alternative solutions that may not been considered by the parties or not possible or available through the courts. </div><div>One huge advantage for mediation process is the cost, this process can be cheaper than the other two depending on the who you go through. </div><div><br></div>]]></description>

         <description><![CDATA[<div>I chose negotiation because the parties can exchange messages between one another, discussing and clarifying the problem occurred on what they agreed to and settle their differences to avoid argument and disputes. They can come to an understanding to achieve the best result or outcome. ADR helps resolve disputes in many different contexts. It allow the two parties to come to a resolution that they both can benefit. ADR give the best alternative option available that they can negotiate. Both parties need to listen to each other, not to judge, be knowledgeable of what they are negotiating and prepared to persuade and express thoughts verbally. ADR negotiation phases are to exchange, bargain and close out the parties dispute and solve the problem. ADR process works in negotiation discussion and is an acceptable way for both parties to resolve their issues in several ways (B2B, B2C and B2E). Negotiation to me helps both parties come to a suitable and equal decision. </div>]]></description>

         <description><![CDATA[<div>Negotiation is a good method of ADR because both parties can come together to state and discuss the problems that both party's have, and come to an agreement without moving on a litigation, that would save them lots of time and money between the two. Also the negotiation process has a big advantage on it's cost efficiency. you will spend little to no money when negotiating unlike the other two, when you have to hire someone to mediate or arbitrate the dispute between the two company's.</div>]]></description>

         <description><![CDATA[<div>Cases of disputes are on the rise in business jurisdictions. The parties involved are at liberty to choose ways of settling their disputes. They can solve their disputes using judicial authority or out of courts using Alternative Dispute Resolutions (ADR) methods. Mediation is one of my favourites of the four commonly used methods of ADR, which are arbitration, conciliation and negotiation. It employs a neutral third party in settling the matter of dispute involving the disputants. I prefer mediation since it preserves the relationship of the disputing parties and even makes it more robust after the process.<br><br></div><div>According to me, mediation is the most appropriate way of solving a dispute. It is done privately and the parties involved can come up with their agreement in settling the matter of contention without imposition. A mediator can help to scale down emotions in case they run high in the process of mediation. Mediation helps the disputants to re-establish an even stronger business relationship after the dispute beating them has been resolved.<br><br></div><div>Mediation in comparison with arbitration is less costly, and it saves time. Hiring a mediator is relatively cheaper, and the parties determine it. The services of an experienced mediator can help to settle a dispute quickly. Arbitrators are paid a given fixed fee just like lawyers who make the process to be expensive compared to mediators. .Arbitration process takes quite some time in resolving a dispute. The time taken is directly proportionate the cost of arbitration.<br><br></div><div>To sum up, I find mediation to be the most amicable, peaceful and inexpensive method of Alternative Dispute Resolution. It is done in private, hence, helping to keep the matter of contention confidential and the settlement is not imposed on the disagreeing parties. It explores and offers alternative solutions to the problem that the disputing parties could not have considered.<br><br></div><div><br></div>]]></description>
