A losing party in a judicial ruling in a district court may request an appeal, in which case a court of appeals will reassess the trial and sometimes provide a new ruling. There is no jury, it is up to the judge to assess the previous ruling in accordance to the fairness of the law. The court of appeals monitors all Courts, making sure that there is no incorrect legal determinations. There are many courts across the country, some state specific or specialized, like the Texas Court of Criminal Appeals, only dealing with Criminal cases in Texas.

The district courts are the lowest of the courts, and provide the first ruling on a case. They conduct trials on civil or criminal issues, ordinarily with a jury of usually 12 people, but sometimes without a jury. The judges in courts manage the trial and assess the evidence and interprets the law. In a jury trial, the jury makes the final decision. In a bench trial, the judge makes the final decision. The defendant can choose which type of trial will occur. They may choose a bench trial over the regular jury trial because it is often faster, and the judge is sometimes more impartial to politically charged issues.
