Quentin, the editor and food critic for the Nottingley Express newspaper, went to review a new

restaurant owned by Raymond. Whilst eating his starter, Quentin overheard a conversation

between the head waiter, Simon, and a waitress, in which Simon said very loudly that, “As well

as cooking the food, Raymond is also cooking the books. He’s the biggest rat in the kitchen

and, as you know, there are lots of them.” Simon had a grudge against Raymond, as he was

recently demoted as restaurant manager.

Quentin published his review under the headline “Raymond the Rat: Restaurant Infested”. In it

he alleged that Raymond’s food was rubbish, that the restaurant was full of rat droppings and

that he was in trouble with the Inland Revenue. Before publishing the review, Quentin

telephoned the restaurant for a comment, but Raymond has always refused to speak to food

critics.

In fact, Raymond’s restaurant had recently passed a full hygiene inspection, his accounts are

accurate and his taxes are up to date. As a result of the allegations, Raymond’s restaurant has

suffered a significant loss of business.

Advise Raymond as to any remedies he might have in tort.

Anna, a leading specialist in heart surgery, was driving along the motorway with her husband,

Barak. They witnessed an accident when a lorry burst into flames and overturned. No other

vehicles were involved and the reasons for the fire were never discovered.

They stopped to help and Anna gave first aid to Dan, the lorry driver, who had severe burns.

Anna failed properly to clean the burns before applying bandages.

On admittance to hospital Dan was treated by a junior doctor, Sonya, who had been left in

charge of the burns unit. She failed to give him an antibiotic injection. Dan suffered a serious

infection that required a long period in hospital and eventual amputation of his left arm.

Evidence suggests that the antibiotic injection may have prevented the infection, but there is

still a chance that infection would have occurred anyway.

Advise Dan as to his legal rights, if any, in tort
