         <description><![CDATA[<div>Bakke sued the University of California in a state court stating that the Medical School violated Title VI of the Civil Rights Act of 1964 and the Fourteenth Amendment's Equal Protection Clause. The Supreme Court agreed and ordered the school to shut down the quota. The school repealed making the case go into review in 1978.</div><div><br><br></div><div><br></div>]]></description>

         <description><![CDATA[<div>On October 12, 1977, there was an <strong>oral argument.  </strong>The <strong>Concurring Opinion </strong>was that the use of racial quotas as a part of the admissions process was unconstitutional because it violated Title VI of the Civil Rights Act of 1964 but affirmative action could be used depending on the circumstances . The <strong>Dissenting Opinion  </strong>was that the<strong> </strong>University of California believed that they were not implementing racial quotas and they disagreed with the ruling. The <strong>Opinion of the Court </strong>was on June 26, 1978 agreed with the concurring opinion and ordered Bakke's admission.</div>]]></description>

         <description><![CDATA[<ul><li>Following the Supreme Court of California’s ruling, <strong>the Regents of the University of California filed a writ of certiorari </strong>to the Supreme Court, <strong>focusing on the constitutionality of Davis Medical School’s special admissions program under the Equal Protection Clause of the Fourteenth Amendment.</strong>The <strong>Supreme Court granted certiorari upon the validity of the special admissions program </strong>under the Equal Protection Clause of the Fourteenth Amendment. <strong>As a result of the Supreme Court’s decision to grant certiorari, the Supreme Court of California’s order to grant Allan Bakke’s injunction was pending the Supreme Court’s ruling on the constitutionality of Davis Medical School’s special admissions program. The Regents of the University of California failed to state a claim upon which relief could be granted.</strong></li></ul><div><br></div>]]></description>
