Is this qualifying work?: A father and his child return to visit family in Mexico after their work in agriculture in OR has ended. Upon returning, the father find work for a nursery. His task is to transport nursery products to retail stores.

Transporting plants within the nursery is qualifying work. However, OME does not consider transporting a product to a market, wholesaler, or processing plant to be production or initial processing. (NRG F-26)

#1 If a family goes 3 weekends from Eugene to Salem, and arrives to work there in 2 hours and then work Saturday-Monday with the children, would they qualify?

The recruiter would need to establish that economic necessity was a factor in these moves by completing the Oregon Additional Form and the children would have to make each move with or to join the worker. Weekend moves will be questioned, especially if the moves are done once every three years and not showing a history or pattern of these moves for the family. The intent of the MEP is to qualify eligible children. The law was created to serve migrant children who make qualifying moves with their families and due to their migrancy, have their education disrupted.

#2 A move of 5 days with 3 days of work and 2 days of travel could count for the series of 3 moves?

Based on the new policy, a move that involves engagement in work of 3 days is the minimum acceptable duration for a short move, in the series of 3 moves in a 12-month period. Only the days engaged in work will be counted in the series of three moves. There may be an exception such as in #1 but it will be rare that other exceptions are made.

#3 At what point does a recruiter need to decide if a family qualifies based on the regular job of the parent, for example as a dental assistant, do they qualify for the MEP if they make a move with their children to work in agriculture?

The best practice is for the recruiter to ask additional questions (Oregon Additional Form) and keep this information for their records in case there is ever a question about the eligibility verification. The form is part of the Quality Control Process and it will be reviewed and included during the re-interview process. It is essential to keep documentation that show that the family is meeting the eligibility guidelines. See #3 above for more information.

#4 How do we respond to families about the change in policy without telling them so that we are not giving them too much details?

The recruiter can simply share that the guidelines for determination of eligibility for the migrant education program regarding moves of short durations have been updated for the entire state of Oregon, effective February 15, 2023. Policy updates are part of the process of quality control as the State Education Agency (the Oregon Department of Education) makes every effort to ensure that eligibility determinations are accurately recorded on COEs

#5 Scenario: a School district employee who does not work in the summer, goes from Oregon to AZ to work in lettuce with the children for 3 weeks, do they qualify?

In Oregon, any person or family has the right to engage in any work, including in agriculture or fishing employment but it is Oregon’s responsibility to qualify this person and child for the MEP. Oregon is responsible for qualifying and serving only eligible children. Is this school employee moving to see relatives, take a vacation, or move to engage in new qualifying work, and/or other reasons? The MEP serves eligible children who truly need the services under the Title I Part C program. Just because the family works in agriculture or fishing, it does not mean the children qualify in the Oregon MEP. Outside of the random selection process, the re-interviewing procedures does allow the MEP to select any family to verify and determine if the family qualifies.

#6 Move 1 MAW moves, Move 2 MAW moves, Move 3 MAW and children move, do they qualify?

Need more information. The Oregon Short Duration Move Policy states that the minimum duration of a move is 3 days engaged in work and a series of 3 moves is required in a 12 month period. The recruiter would need to know how long these moves are for the worker to be engaged in the work and determine if the children meet the definition of migratory child. If children are joining the family for a visit in the new location, that would not indicated a qualifying move. Here is a description from the NRGs that we should keep in mind:

The recent Oregon policy of moves of short duration provides direction on how a migratory worker and migratory child must stay in a new place long enough to show that the worker and child “moved,” i.e., changed residence due to economic necessity. It specifies the number of moves and days and moves from previous guidance of the 72-hour qualifying move. This question and similar scenarios will be treated on a case-by-case basis. An important part of this and any other scenarios, is to look at the history of the migratory worker and child(ren). Additional questions may be considered such as “Is this a one-time move in the last three years” and others. Asking good questions, such as open-ended, indirect, probing, and other ones will help the recruiter gather the needed information.

#8 MAW moves from October 3 to November 3; children join the worker on the weekends for 3 consecutive weekends so that they do not have to miss out on school. They went for 2 days (3 times) would they qualify?

If the children only visit their parents on weekends, this does not constitute a “to join” move. It is nice the family is together but to join the family and stay for the weekend, is not to live and attend school, etc. This is only a visit

On September 4, 2020, Hernan and his 2 school-age boys moved from Lindsay CA, to Adrian, OR to take a temporary job milking cows on a dairy farm. This job lasted only a few months and led to a period of unemployment. On March 12, 2023, the family moved to Lincoln City, OR where Herman got a job working at a casino. The family was found by you, the recruiter, in April of 2023, and you completed a COE for the 2 children.

After a few months the family moved to Las Vegas, Nevada where Hernan took a job in a casino once again. On January 10, 2024, the family returned to Lincoln City, OR and was not successful in securing employment. You interview the family again today.
