DEFINITION OF AL-AHLIYYAH

Al-Ahliyyah can be defined in terms of language and terminology:
i) Language:
Al-ahliyyah in terms of language is qualification, expertise. It comes from the word ahl, which means a person who is qualified or skilled in something.
ii) Terminology:
the qualification of a person to receive all the rights and responsibilities prescribed for him.

DIVISION OF AL-AHLIYYAH

i) Ahliyyah Al-Wujub - a person's qualification for the necessity or membership of an individual to convict the rights for him such as the rights of value. This ahliyyah is life or human nature, so every human being is ahliyyah al-wujub when he is a fetus in his mother's womb.

Ahliyyah Al-Wujub is divided into two:
a - Ahliyyah Al-Wujub Al-Kamilah

That is the individual's qualification to convict the rights to receive perfect.
It is different from Naqisah from the point of view of accepting his right because it is continuous without depending on certain circumstances. The human stage that is in this qualification is a newborn baby until the end of his life.

b - Ahliyyah Al-Wujub Al-Naqisah
That is the eligibility to receive imperfect rights.
The qualification of an individual to convict the rights for him alone must be certain. In other words, the sickle must exist for the fetus in its mother's womb before birth.

ii) Ahliyyah Al-Ada' - the qualification to implement or fulfill sharia management. That is management that gives the effect of laws; valid and invalid, halal and haram. A person who performs the management must be eligible for rights and fall on his obligations.

It does not include ahliyyah al-ada' for children who are not mumayyiz who are under the age of seven because their intellect is still raw and weak. It is not valid to buy and sell with him and all his expenses are null and void.

Ahliyyah Al-Ada' is divided into two:
a - Ahliyyah Al-Ada' Al-Naqisah
That is the qualification to perform which is not perfect. Which, the qualification to carry out a given management or action, but not all of them can be carried out alone, it must depend on the other party, the guardian.

This type of al-ahliyyah convicts individuals at the mumayyiz stage after seven years. They have perfect receiving qualifications but imperfect performing qualifications.

As for the rights of slaves on the side of Syafi'ie and Ahmad, the period of the child's aqad and expenses are void. As for Al-Hanafiah's side, it says that wealth is divided into three, namely:
- Giving benefits
- Causing harm
- Giving benefit and harm

b - Aliyyah Al-Ada' al-Kamiliah

That is the perfect performance qualification. Which, the qualification to carry out a management or action is free according to his wishes and has full mental development, even if there is a risk that he himself will bear.

This qualification is given at the stage of puberty and rushd because it is also convicted for anyone who has reached the age of maturity, i.e. rashid puberty. So for him it is obligatory to be responsible every aqad.

OBSTACLES AL-AHLIYYAH

In Al-Ahliyyah there are some obstacles ('Awarid Al-Ahliyyah) that can disqualify. Its existence will prevent a person from making transactions and managing property in certain circumstances.

1) 'Awarid Samawiyah (natural obstacles) which is what a person doesn't have in trying and earning.
for example : crazy, 'atah, al-ighma', sleeping, and deathly ill.
2) 'Awarid Muktasabah (obstacles obtained) which is what happens to someone who has entered and strives for his income.
for example : drunkenness, safih, and debt.

After finding out about the existence and method of using this e-portfolio, it made me more interested and interested in using it even more. in my view, e-portfolio is an application that is very suitable for students to put their notes using their own creativity. This also makes it easier for me to read and revise the topics that have already been studied.

AKAD or contract is a symbol or sign of willingness between two contracting parties. Sighah is an important pillar in a contract without which the contract is considered invalid.

This can be traced through firman Allah and words of the Prophet SAW. Among them is the word of Allah SWT which means: Except what is halal (you eat), that the property of the business, is done willingly among you. (An-Nisa': 29).

Likewise the words of the Prophet SAW, on the authority of Abu Hurairah r.a on the authority of the Prophet SAW, he said: "The two parties who buy and sell cannot separate except after there is consent between them". (narrated by Abu Daud and Tarmizi)

Sighah or simply referred to as the wording of the contract is one of the pillars that must exist in a contract. Scholars agree that the absence of sighah will affect the signed contract. This means, a contract will not be valid without the occurrence of sighah.

Sighah contains two components which is ijab and qabul expressed by both contracting parties.

Ijab is to offer something to be accepted. For example, "I sell this item to you at the price of RM100", "This item is for you at the price of RM200".

Qabul is accept. For example: "I bought this item for RM100" or "I received this item for RM200".

The expression can occur either through words, writing or gestures. Provided that the sighah must be clear from all aspects.

If something happens that is not clear in the signah of the contract, it can cause the contract to be void. This is so because it is classified as a defect in the contract and causes a breach in the contract.
