         <description><![CDATA[<div><br>Before we dive into the costs involved with <strong>a)</strong> traveling to Mars, <strong>b)</strong> building a home on Mars, and <strong>c)</strong> having sustenance on Mars while you’re there, let’s address the dusty red elephant in the room: can you actually buy Martian real estate?</div><div><br>According to the extraterrestrial real estate agency Lunar Embassy, which sells Martian property via its website BuyMars.com, the answer is an unsurprising “Yes.”</div><div><br>As their website clearly states:</div><blockquote><em><br>“… Lunar Embassy is THE ONLY COMPANY in the world to possess a legal basis and copyright for the sale of Planet Mars …The </em><a href="http://www.unoosa.org/oosa/en/ourwork/spacelaw/treaties/introouterspacetreaty.html"><em>UN Outer Space Treaty of 1967</em></a><em> stipulates that no government can own extraterrestrial property. However, it neglects to mention individuals and corporations.”</em></blockquote><div><br>Essentially, Lunar Embassy is exploiting a loophole in a treaty that was designed to prevent countries like the U.S. and Russia from claiming ownership of celestial bodies (and potentially going to war over them).</div><div><br>They argue that since I’m a person, not a country, the treaty doesn’t apply to me. And I’m free to buy all the Mars real estate I want.</div><div><br>So I guess the first step toward owning a vacation home on Mars is buying a plot of land to build on. And while I’m no Martian real estate expert, it certainly seems like a buyer’s market: <strong>Land on Mars starts at just $29.99 per acre</strong>.</div><div><br>And yes, in case you were wondering, that price includes your official “Mars Documents” complete with “Futuristic Packaging.”</div><div><br>Because as well all know, nothing says “this is a legitimate business transaction” like futuristic packaging.</div><div><br>If you’re not 100% sold on Lunar Embassy’s claims … good. That means you are a smart person and have a bright future ahead of you.</div><div><br>One of the major flaws in Lunar Embassy’s argument is the notion that citizens of countries are somehow exempt from the international treaties their parent countries adhere to.</div><div><br>After all, it’d be ludicrous to assume that it’s legal for a person to buy nuclear weapons on the grounds that the international Non-Proliferation Treaty only applies to countries, not individuals.</div><div><br>Another issue with owning Martian real estate: There’s no government around to enforce property rights, which means your “Mars Documents” can’t really guarantee you anything.</div><div><br>Mars, like the rest of the universe, is a frontier.</div><div><br>According to astrophysicist Neil deGrasse Tyson, a proposed solution for managing Martian real estate is to impose a “homesteading” rule. Here’s how he explained it on a recent episode of his <a href="http://www.startalkradio.net/show/cosmic-queries-colonizing-mars/">StarTalk</a> podcast:</div><blockquote><em><br>“The Outer Space Treaty has provisions in it that says the universe is a frontier, and you can’t own it, there’s no sovereign control over it. Now, at some point that’s going to have to change. You go to Mars, and people start pitching their flag and they build a home, well you can’t say that no one owns the home, “I built the damn home.” So what is likely, or rather, what has been proposed, is that you put a homesteading kind of rule in place.          <description><![CDATA[<div>There are several international treaties that bear on this subject, but the most important is the <em>Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, Including the Moon and Other Celestial Bodies </em>signed on January 27, 1967 . This treaty is usually called the Outer Space Treaty of 1967 or the OST for short. You can read the treaty and the US State Department’s explanation of it here: <a href="https://www.state.gov/t/isn/5181.htm">Outer Space Treaty<br></a><br></div><div>The relevant provision of the OST is Article II which states: “Outer space, including the moon and other celestial bodies, is not subject to national appropriation by claim of sovereignty, by means of use or occupation, or by any other means.”<br><br>So, in summary, the OST says that no nation can exercise sovereignty over any body in outer space, including the moon.
