In Florida, this begins at age 12 and may not end until 22, pursuant to federal and state law.

  • Is designed to be within a results-oriented process, that is focused on improving the academic and functional achievement of the child with a disability to facilitate the child’s movement from school to post-school activities, including postsecondary education, vocational education, integrated employment (including supported employment); continuing and adult education, adult services, independent living, or community participation

  • Is based on the individual child’s needs, taking into account the child’s strengths, preferences, and interests; and

  • Includes instruction, related services, community experiences, the development of employment and other post-school adult living objectives, and, if appropriate, acquisition of daily living skills and functional vocational evaluation

A student with a disability who meets the standard high school diploma requirements may defer the receipt of the diploma and continue to receive services if the student meets the requirements found at Section 1003.4282(9) (10)(c), F.S. The IEP team must review the benefits of deferring the standard high school diploma, including continuation of educational and related services, and describe to the parent and the student all services and program options available to students who defer. This discussion must be included in the IEP.

The decision to accept or defer the standard high school diploma must be made prior to the beginning of the school year in which the student is expected to meet all requirements for a standard high school diploma. A signed statement by the parent, guardian or student, if the student has reached the age of majority and rights have transferred to the student in accordance with subsection 6A-6.03311(8), F.A.C., that he or she understands the process for deferment and identifies if the student will defer the receipt of his or her standard high school diploma, must be included in the IEP.  School districts must inform the parent and the student during the year in which the student is expected to meet graduation requirements, that failure to defer receipt of a standard high school diploma after all requirements are met releases the school district from the obligation to provide a free appropriate public education (FAPE). This communication must state that the deadline for acceptance or deferral of the diploma is May 15 of the year in which the student is expected to meet graduation requirements, and that failure to attend a graduation ceremony does not constitute a deferral.

Changing Lanes: Deferring Receipt of a Standard Diploma

Students with disabilities may defer receipt of their diploma and continue to receive educational services through the school district if the IEP Team determines that there is a need for continued services. There are two parts to deferral:

1.      The student must have an IEP that “prescribes special education, transition planning, transition services, or related services through 21.” This means that, because of the disability, a student must need continued education and services.

2.      The student must be enrolled in one of several specific programs. Refer to the chart on this page for programs and their descriptions.

To assist students and youth with disabilities in achieving their post-school and career goals, Congress enacted two key statutes that address the provision of transition services: the Individuals with Disabilities Education Act (IDEA) and the Rehabilitation Act of 1973 (Rehabilitation Act), as amended by Title IV of the Workforce Innovation and Opportunity Act (WIOA). Both the IDEA and the Rehabilitation Act require transition services be made available to students and youth with disabilities as they prepare for and enter postsecondary life. Both laws also make clear that transition services require a coordinated set of activities within an outcome-oriented process that relies upon active student involvement, family engagement, and cooperative implementation of transition activities, as well as coordination and collaboration between the vocational rehabilitation (VR) agency, the State educational agency (SEA), and the local educational agencies (LEAs).

To aid in a seamless transition from school to post-school activities, this transition guide addresses the following topics: Transition planning: opportunities and programs; Transition services and requirements, as authorized by IDEA and the Rehabilitation Act; Education and employment options for students and youth with disabilities after leaving secondary school; and Supporting the decisions made by students and youth with disabilities.

The Fair Housing Act makes it unlawful to refuse to make reasonable accommodations to rules, policies, practices, or services when such accommodations may be necessary to afford persons with disabilities an equal opportunity to use and enjoy a dwelling and public and common use areas. In addition, the Fair Housing Act prohibits a housing provider from refusing to permit, at the expense of the person with a disability, reasonable modifications of existing premises occupied or to be occupied by such person if such modifications may be necessary to afford such person full enjoyment of the premises.
