Amnesty International has demonstrated that Israel has imposed a system of oppression and domination over Palestinians wherever it exercises control over the enjoyment of their rights – across Israel and the OPT (Occupied Palestinian Territories) and with regard to Palestinian refugees. The segregation is conducted in a systematic and highly institutionalized manner through laws, policies and practices, all intended to prevent Palestinians from claiming and enjoying equal rights to Jewish Israelis within Israel and the OPT, and thus intended to oppress and dominate the Palestinian people. This oppression and domination have been cemented by a legal regime that controls (by negating) the rights of Palestinian refugees residing outside Israel and the OPT to return to their homes.

The organization has concluded that Israel has perpetrated the international wrong of apartheid, as a human rights violation and a violation of public international law wherever it imposes this system. It has assessed that almost all of Israel’s civilian administration and military authorities, as well as governmental and quasigovernmental institutions, are involved in the enforcement of the system of apartheid against Palestinians.

The Rome Statute established four core international crimes: (I) Genocide, (II) Crimes against humanity, (III) War crimes, and (IV) Crime of aggression. Following years of negotiation, aimed at establishing a permanent international tribunal to prosecute individuals accused of genocide and other serious international crimes, such as crimes against humanity, war crimes and crimes of aggression, the United Nations General Assembly convened a five-week diplomatic conference in Rome in June 1998 "to finalize and adopt a convention on the establishment of an international criminal court".^[10][11]

Soon after Israel occupied the West Bank, including East Jerusalem, and the Gaza Strip, in June 1967, the Israeli military authorities consolidated complete power over all water resources and water-related infrastructure in the Occupied Palestinian Territories (OPT). 50 years on, Israel continues to control and restrict Palestinian access to water in the OPT to a level which neither meets their needs nor constitutes a fair distribution of shared water resources.

In the OPT, movement restrictions, land expropriation, forcible transfer, denial of residency and nationality, and the mass suspension of civil rights constitute “inhuman[e] acts” set out under the Apartheid Convention and the Rome Statute. Under both legal standards, inhumane acts when carried out amid systematic oppression and with the intent to maintain domination make up the crime against humanity of apartheid.
