10:09am Plaintiff emailed saying they have not heard a response and can not confirm offer.

Defendant then change their offer to $300k with the limitation that Defendant will not accept an offer that is valued $50k- $75k greater than the current offer.

Later in an email, Defendant made a firm offer of $300k.

Defendant submitted an affidavit stating that the $300k proposal was a rejection of the $250k offer.

3:51pm correspondence was sent stating that the Defendant was not going to accept.

Plaintiff responded via email at 4:55pm that they accept $250k if PACA accepted a lien reduction to $50k.

This was followed up with a second call from the Defendant making a counteroffer of $400k.

After conferring with the President of the company, a representative from the Plaintiff's company emailed the Defendant proposing a $250K offer.
