         <description><![CDATA[<div>How do the ARD Requirements impact your work? </div><ul><li>The ARD requirements really set the rules and expectations for the Special Education ARD process. ARD requirements are the legal guidelines that dictate many things like time frames, best practices, and resources and contacts needed when unique or questionable situations occur.</li></ul><div>Are there legal requirements or compliance issues you regularly monitor or have to be attentive to in this area?</div><ul><li>Monitoring placement dates drive students receiving services and eligibility testing before their eligibility expires at the three-year marker. Also, being tentative to newly enrolled students and whether or not they received special services at their previous campus.</li></ul><div>Are there any policies or rules you have currently written or revised related to this issue? </div><ul><li> Currently working on procedures for special education services at private entities such as church schools, private schools, mental health facilities, and juvenile detention centers that serve special education students. Recently public school special education department has been expected to assist with private entities and their service of special needs students.</li></ul><div>Is there current or pending legislation related to this issue? </div><ul><li> The new legislation about the public school system expected to be responsible for making sure that special needs students receive appropriate services. Possible new legislation related to special education and COVID 19.</li></ul><div>Do court cases and their decision impact your work? </div><ul><li>We usually study cases and the decisions to decide how to implement procedures and prevent cases within our own district.</li></ul><div>Are there certain student or employee rights that relate to this issue? </div><ul><li> There are more rights for the students and parents identified in the ARD requirements. </li></ul><div>Can you share a situation related to this issue and how you resolved it? </div><ul><li> One of the challenging things to address is compensatory services, were to want more services or feel as if their student did not receive enough service, to address this it is difficult to organize and get because of finding the budget to pay after-hour services since students can not be pulled out of their classes. </li></ul><div>Have you attended or provided any trainings recently on this topic? </div><ul><li> Due to COVID, the annual 48-hour legal training where lawyers come to present cases and popular points to look for. </li></ul><div>How do you stay current on this topic?</div><ul><li> To stay current on ARD requirements, there are trainings available and subscribe to TEA, SPED network, follow the LawDog blog, and updates from supervisors.</li></ul><div><br><br></div>]]></description>
