It is non-rival because everyone can benefit from water drianing out of the streets and no one is getting more of a benefit than another. The sewer system is non-excludable because there is no way to exclude someone in our society from benefiting from the sewer system.

Even though sometimes it may seem that many of us are ripped off with the large sizes and the subsequent little percentage of drink actually in the cup, it is rather in the best interest for us. There is actually a time when there can be "too much" of a drink and this is when diminishing marginal utility takes place. As we drink more and more of a certain drink, our interest peaks and starts to decline rapidly.
