Also known as the Presumption of Innocence, this law requires that a judge not only instructs themselves but also a jury to look at a defendant and believe they are innocent until all the evidence has been shown and they can say without a doubt that that person is guilty. Many of us are familiar with this law (most likely from t.v. crime shows) and it is a law that is meant to be used in every case in the U.S. However some people believe that our system does not protect this right efficiently and not from corrupt judges or biased juries but from much more trusted threats. For years there have been thousands of cases against people that were later discovered to be solely based on the reportings from the media or the mal-testimony of a witness. Another right used by everyone every day is the Freedom of Speech. Because of this people are able to speak freely and the news/media are able to write about whatever they please, as it should be, but sometimes the stories are not true and innocent people get put behind bars

The main opposition to this argument isn't really even an opposition but more of a concern on how it should be handled. They don't believe that falsely accusing someone is Ok but they do believe that adding more regulations to what the media can report on would infringe on our First Amendment rights.

What Can we do?

We can't try to change laws and put restrictions on what can be said in the news. And we can't disregard every witness's or victim's claims as a lie. So what can we do? In my opinion sometimes our greatest defense is to be aware. Be aware that the news although informative isn't always reliable. Be aware that there is always 2 sides to the story (even if you don't want to hear one of them). And that is exactly what the Presumption of Innocence was put in place for. To make the people aware that evidence is just as important as the claims.
