         <title>Spirit and Letter of the Law</title>

         <description><![CDATA[<div>Oberti v. the Board of Education would have a substantial impact on Andrew. This case had a significant impact on special education. It encourages schools to consider a greater range of inclusive services in settings for students with disabilities before resorting to segregation.&nbsp;<br><br>The Letter of the Law v. The Spirit of the Law:<br>These phrases are used often in the field of education to refer to the way different people comply with laws that have been passed. If a person complies with the “letter of the law,” he or she is acting within the literal interpretation of the law as it is written. If a person complies with the “spirit of the law,” he or she is acting according to the intent of those who wrote the law. It is possible to act within the letter of the law, but not the spirit of the law, and vice versa. Under IDEA, section 504, and ADA, people act within the letter of the law when they follow procedural due process an implement accommodations when mandated. To act within The spirit of these laws means to act according to the intention of those who wrote them. The authors of these laws believe that persons with disabilities deserved equal opportunities, and that they are valuable as citizens in the community, in the workplace, and in the classroom.&nbsp;</div>]]></description>
