All legislation and regulation surrounding human cloning is very strict on a commonwealth level. The three acts concerning human cloning effectively ban all interaction with a human embryo unless used for its intended purpose or storage of the embryo itself. Each of the state laws only work to further prohibit work and research around human embryos, with WA having legislation on human cloning as early as 1991. NT is the only state to not currently have a state legislation on human cloning or embryo research.

The article establishes that the Research Involving Human Embryos Act 2002 and the Prohibition of Human Cloning Act 2002 has strict and mandatory legislations surrounding human cloning and regulates uses of excess human embryos created through reproductive technology. This is to clearly define what is not allowed and illegal in Australia, and sets up boundaries to ensure that there are no unsafe practices of human embryo testing. The Commonwealth set mandatory legislations, as well as additionally each state and territory in Australia set independent legislation to ban human cloning and other unacceptable practices to regulate research involving embryo research and testing.
