Hugh Harper, a Partner at EY, delivered the keynote address at Jersey Finance’s Annual Review breakfast event on January 28. Harper took the opportunity to discuss new research that outlines the potential for Jersey to adopt a new approach to banking. During an introduction to the event, Geoff Cook, the CEO of Jersey Finance, described 2015 as another solid year for the finance industry, highlighting the upward trend in industry employment. He highlighted ongoing efforts to differentiate Jersey from other international financial centers, stating: “We remain focused on strengthening Jersey’s competitive position through innovation and research and, alongside the major Future of Banking project to be finalized this year, we will be producing a new report entitled ‘Jersey’s Value to Europe’, which will clarify Jersey’s role in contributing to jobs and growth within the EU. A new piece of work to clarify the finance industry’s contribution to the local Jersey economy will be completed too.”

“The growth we have seen across our funds, private wealth and capital markets sectors, together with the investment we are making in diversifying and enhancing our banking platform, stands us in very good stead, and we are seeing growing interest from fund managers and family offices in establishing a presence in Jersey. All this is filtering through to the local economy, with firms in the industry predicting a rise in employment for local people over the coming year and the industry recruiting more local students than ever before.”

Collaborative efforts among anti-fraud organizations and between government agencies and insurers have grown in recent years. They have led to successes in detecting fraud, passing needed legislation and a greater awareness of fraud by the general public. Among the collaborations and successes the report cites:

 

• The Healthcare Fraud Prevention Partnership, an alliance of more than 60 insurers and government agencies, logged $250 million in savings,

 

• A grassroots legislative initiative by the Coalition and the International Association of Special Investigation Units (IASIU) help enact meaningful legislation on the state level,

 

• A consumer outreach program created by the Pennsylvania Insurance Fraud Prevention and the Coalition has helped Coalition members share anti-fraud messages with millions of consumers.

 

The report also highlighted a collaborative effort between the district attorney’s office in Philadelphia and insurers that helped take down a large ring that made $400,000 of claims for phony slip-and-fall injuries on residential sidewalks. Asst. DA Linda Montag partnered with investigators to convict nearly the entire ring. Only ringleader Andrew Gaber evaded conviction by committing suicide. Montag received the Prosecutor of the Year Award at the Coalition’s member meeting. 

 

The annual report, titled Uniting the Fraud Fight, also outlined many of the successes of the Coalition in 2015 including expansion of its social media efforts, growth in membership and ability to provide the fraud-fighting community with trend information and intelligence to combat fraud.

I grew up in the Northeast, and now live in a Mid-Atlantic state. I understand Fall. The weather is crisp and the leaves turn colors. Happens every year.

 

Just like the leaves turning colors in the Fall, someone predictably come up with a supposedly great idea: let consumers buy health coverage from insurers across state lines.

 

The argument is always the same: Interstate sales increases competition and reduces costs for consumers. This sounds workable on paper. The latest go-around was raised in this past week’s presidential debate as the fall leaves tumbled — just like consumer protections.

 

Problem is, interstate sales open the door wide for fraud, and water down consumer protection. And, most people advocating this system usually don’t include important and necessary protections when pushing their interstate plans.

 

Yes, neighboring states can legally create partnerships that allow insurers to cover consumers in any state within the partnership. Yet partnerships have strict, built-in legal protections when states agree to work together. Insurance regulators know who’s doing business. Networks also offer consumers choices of doctors and facilities.

 

These protections and coverages may not exist under a blanket permit for consumers to buy coverage in any state.

 

Consumers don’t know what insurance regulator to reach for help. And would the regulator in the state where the consumer lives have much incentive to help if the health insurer is domiciled another state? Would the regulator where the insurer is domiciled help a consumer living in a different state?

 

We already see crooks peddling bogus health insurance to unsuspecting consumers and small businesses. This problem would be magnified if interstate sale of health insurance was allowed without strict and well-defined oversight. 

 

Insurers must be state-licensed to do business in a given state. How can state oversight properly protect consumers if anyone can offer insurance to any consumer in any other state?

 

Who makes certain the insurer is solvent and can do business in another state? And, would an insurer in one state have an adequate network of doctors, hospitals and pharmacies to cover the health needs of consumers in another state?

 

These questions are raised every time interstate health-insurance sale is broached. Yet we never hear answers — just the simplistic nostrum that interstate sales will help reduce healthcare costs.

 

Don’t just spoon out more words like falling autumn leaves — prove that consumers would be better protected.

Earlier, Government of India managed to get Mauritius and Cyprus to amend tax treaties to impose capital gain tax & avoid round-tripping of funds into the country some of which was said to be black money.

 

The above measures aim to reduce revenue loss, prohibit double non-taxation, consolidate the flow of investment and also trigger the interchange of knowledge between the two countries. It is also anticipated to reduce unpredictability in the market, by possibly intimidating non serious investors. Such amendment shall tackle the long pending issues of treaty abuse & round tripping of funds

 

Source based taxation approach will certainly have an impact on foreign investments from Mauritius, Cyprus & Singapore as investments will now have to factor in the capital gains tax. This amendment will bear a brunt on prospective investments transmitted in India. These amendments have brought in much more lucidity to the existing provisions thereby boosting confidence in investment related decisions. From this viewpoint, this amendment is indeed a much required one.

 

Considering that Governments globally are taking various actions against treaty abuse provisions and also implementing various Base Erosion and Profit Shifting (BEPS) initiatives, this is a move for better tax transparency and administration.

 

However, there are still some issues on account of this amendment that needs stringent evaluation. Some of the issues which needs clarity area as follows:

 

Currently, only shares are covered under the capital gains withdrawal. Compulsorily Convertible Debentures (CCDs) have not been dealt with. Thus, would a transfer of a CCD then result in capital gains? In order to claim grandfathering provisions, does it imply, the CCDs should be converted to shares before 31 March 2017 to be eligible for the exemption.

 

The bigger issue pertains to participatory notes or P-notes as they are popularly known. According to media reports, around 30 to 50% of the P Notes money is routed through ETF (exchange traded funds). Taxing ETF will impact liquidity in the market and probably make the investors shift to Singapore exchange to buy Nifty.

 

Another important aspect that should be kept in mind is that India proposes to introduce General Anti-Avoidance Rules (GAAR) effective 1 April 2017.
