There should be steps that should be taken before Emily is committed to a residential program.
Additionally, the family could work with a social services agency to try to address Emily's depression and situation.

To address Emily's situation, it is important to arrange a meeting between the school psychologist, social worker, and her parents to discuss the need for a psychological evaluation and Functional Behavior Assessment (FBA) to monitor her behavior. Based on the evaluation results, a determination will be made if she meets the criteria for classification as emotionally disturbed. Additionally, the school staff will collect data to determine if Emily is eligible for an Individualized Education Program (IEP) and school counseling services, such as group or individual sessions, and regular meetings with the school psychologist.


Following the implementation of the IEP and related services, a 6-month review will be conducted to ensure that Emily is receiving a Free Appropriate Public Education (FAPE) and the IEP is effectively supporting her needs. The goal is to ensure that Emily is receiving the necessary support before considering a residential program.

The district is not currently obligated to pay the fee for a private residential setting as there are numerous steps that need to take place before this occurs. First of all, Emily DOES not have an IEP in place. Due to the fact that Emily has attempted suicide and is struggling with her grades we suspect she could qualify for special education services possibly under the emotional disturbance category. Therefore, we feel she should be evaluated so the CSE team can make that determination. We feel that Emily should currently be provided with counseling through the school district. 

Emily’s father is currently considering a unilateral placement so one thing we discussed was parental placement versus school district placement. Parents are entitled to reimbursement ONLY if school did not make FAPE available to student in a timely manner and if the placement chosen by the parents is appropriate under IDEA.
 
Under IDEA the following questions:
1.     Is the program the LRE?
2.    Must all the costs be born by the district?
3.    What if there is no appropriate accredited placement available?
 
So, in conclusion, once these steps have taken place then the appropriate decision can take place while taking into consideration the parent’s requests.
