The purpose of our case study was to explore the effectiveness of the restorative justice process in post-apartheid South Africa. We found that the process of restorative justice used in South Africa was an exemplary practice that focused on revealing the truth and advancing the reconciliation of the previously oppressed with the oppressors. We studied the history of apartheid, the influential leaders who helped end it, the comparisons between restorative and retributive justice, the emphasis on forgiveness, the role of the religion, the Ubuntu ideals of South Africa, and the counterarguments against restorative justice. Although there were significant flaws, the process of restorative justice and establishment of the Truth and Reconciliation Commission was in fact beneficial in the healing and restoration process as South Africa entered an era of democratic rule.

The Truth and Reconciliation Commission was only a mere beginning to the democracy of South Africa, and the government still has major strides to make in the post-Mandela era. However, for the mothers and fathers that recounted the murders of their precious children and met the perpetrators with compassion and forgiveness, restorative justice was effective. For the wives and husbands who saw the love of their lives raped and tortured and were able to speak out about it, restorative justice was effective. And for the children, who experienced being torn from their parents, the only sense of safety they had ever known, and were later able to attempt to find closure and community in the trials, restorative justice was effective. Restorative justice and the formation of the Truth and Reconciliation Commission was most effective for the people who suffered the most—only a small, yet worthwhile, measure compared to the tragedies they endured.

The Truth and Reconciliation Commission was put in place by Nelson Mandela to help bring the abuses of human rights during the apartheid era into the public eye. It was led by Archbishop Desmond Tutu and sticks to Christian ideals and values within the TRC. These values influenced the major decision of deciding to use the process of restorative justice in post-apartheid in South Africa rather than using retributive justice, like in post-Holocaustic Germany with the Nuremberg Trials. Rather than offering vengeance or violent retributions, the TRC focused on granting amnesty instead (Tutu para. 7).
