Please come to the seminar ready to discuss (from a common sense / fairness perspective) the following problems. Also, consider the significance of the facts as presented to you and why they might influence your decision.

1. Tom, a pilot, offered to take his friend Jerry out for a flight in his new aeroplane. Contrary to statutory regulations, and unknown to Jerry, there were no life jackets on board the aircraft. The plane was caught up in a storm and crashed into the sea. Both Tom and Jerry drowned. Evidence subsequently revealed that the water was so cold that Tom and Jerry would have died within a few minutes from hypothermia, even if they had been wearing life jackets.

Discuss.

Would your answer be different if Jerry had been aware that there were no life jackets on the plane?

2. Pamela was driving home one night when a tyre punctured. She attempted to change the tyre, but without success. Quentin, a passing motorist, saw her plight and offered his assistance. He changed the wheel but failed to tighten the wheel-nuts sufficiently. As a result, whilst driving down the motorway two days later (at 80 miles an hour) the wheel came off and Pamela was injured in the resulting accident. Pamela’s car was also badly damaged.
