Most of the evidence the prosecutors give isn't all that good or well-founded. Their biggest point is the story told by Jay, and that's about it. Other than that, they have phone records, but that's circumstantial.

Jay's Story

Jay has been constantly changing the details of his story. While small details could just be lost to memory, bigger ones like if he helped bury the body, where they went, and more. These changes between stories make Jay seem possibly unreliable.

Adnan's Memory

Adnan doesn't remember anything being too special about the day in which Hae was supposedly murdered. It has been years since the incident and, if it truly was just a normal day for him in which he didn't go out of his way to kill his ex, then he would be unlikely to remember that day.

The Handling of the Case

When reviewing over the case, there seemed to be quite a few times in which the officials involved with the case overlooked something or turned a blind eye to it. This makes them seem unreliable and somewhat suspicious within this case.

Adnan's Attorney

Adnan's attorney for this case was Cristina Gutierrez, a lawyer who was later proven to be a selfish person who would mess with cases to get them to go in a way that would elevate her further. Within this case, it seems she specifically overlooked possible evidence and witnesses that could've helped her win the case.

Alibis

Adnan did have multiple people who said this was completely out of character for him and that they either saw him, didn't see a lack of him, or didn't see him acting too strangely. They also claim that, while he could be a bit weird or annoying whilst in his relationship with Hae, he never was excessively possessive or anything.

Fishy Use of Evidence & Alibis

Throughout the case, possible witnesses were left out and actual witnesses were somewhat forced to shift their stories sometimes to help the case against Adnan. For example, Nisha was put in a position that made her leave out a detail that contradicts Jay's story.

Unreliable Sources

Their main source of evidence is Jay, who's story keeps changing and some of his story doesn't make logical sense. They have an anonymous caller who doesn't have much real evidence behind their claims and Mr.S, a known streaker with a habit of drinking a lot of intoxicating substances. Their final seeming witnesses would be a paper boy known for gossip and some suspicious friends of Jay.

Adnan's Beliefs & Morals

Adnan states within episode 6 that he does not believe that there are "dark sides" to people and that they just are who they are. If Adnan really were to have done this crime, it would completely undermine any and all of his beliefs that he claims to have.
