Warner Bros., who own the rights to the Harry Potter franchise, allowed Universal Studios to license the theme park rights and create The Wizarding World of Harry Potter. And of course, hundreds of smaller, unknown companies manufacture the plethora of merchandise available surrounding the Harry Potter brand.
The advantages is more than the disadvantages in this case
Q2 : I think no because everything Harry Potter is well protected with multiple trademarks that are owned by Warner Brothers Entertainment it also  relate to religion, politics which in those countries they cannot obtain patents or copyright protection.

For example, 1 company want to create a Harry Potter game for some gamers who do not read and watch HP book or movie but it seems like impossible for them to create when they need a license from Warner and this also affects on the percentage of the sale generated by the product.- 
(2) -  Harry Potter does not need patent protection because everything Harry Potter is well protected with multiple trademarks that are owned by Warner Brothers Entertainment. In fact, it's difficult to find something related to Harry Potter that isn't trademarked. Besides, they should obtain copyright protection to protect the original book, movie, and even the characters. Also, they can sue if there are any copyings, abusing and counterfeiting that happen.
