38 year old, Nicholas C. Ashman, from North San Juan, California was pulled over by the Ohio State Highway Patrol for a traffic violation. When the officer pulled Ashman over the officer was able to see that he was nervous and could instantly smell the marijuana smell seeping out of the car.

The officer asked him to show his licenses and registration, which he did. Then Ashman was asked to step out of the car. The officer asked if there was anything illegal in the car that the officer should know about. Ashman said no. The officer warned him that there would be steeper consequences if the officer did find something. But Ashmna kept denying that there was anything in the car.

When the officer started searching the vehicle he found marijuana. The officer went up and arrested him for having the possession of marijuana. The officer called for backup and then kept searching the car. 

When he was done looking through Ashman's 2012 GMC U-Haul box truck they found 101 pounds of marijuana that was worth $235,835.

The search was legal because when the state patrol officer pulled 38 year old Nicholas C. Ashman from North San Juan, California they could smell the marijuana. This is considered an observation skill of a police officer because if a police officer pulls someone over for a traffic violation and they have probable cause to search you then they have the legal right to. 

The fourth amendment states that, "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." The state patrol officer had probable cause of smelling the marijuana in Ashman's car to allow them to search the vehicle.

The significance of Ashman using this U-Haul in this case is that without having this type of vehicle he would most likely not be able to store 101 pounds of marijuana. Also with having a U-Haul the only way that someone would be able to know that he had marijuana with him was if they went in the back. People who see U-Hauls on the road just think that they are moving and are just moving through things to their new home. Most people are not assuming that they having illegal things in the back of them. This is how much marijuana Ashman had in the back of the U-Haul. If he didn't have the marijuana then he would not have gotten caught. He must have not been thinking because if he had them much of an illegal substance with you, wouldn't you make sure that you don't get pulled over? This is significant because of Ashman's decisions of transporting that much illegal marijuana across the country and getting caught that he will be having a punishment. Even tho he has not been officially convicted he will most likely end up in prison because he is being charged with possession and trafficking of marijuana. And both of them are 2nd degree felonies. The 4th amendment is what is causing Ashman to be going to prison.
