         <description><![CDATA[<p> Silver mining operations are increasingly and should be conducted in a manner that minimizes their impact on the surrounding environment; leaving sites more environmentally sustainable , in an acceptable state for re-use and for the sake of the ecosystem. Silver may be extracted in various ways,some better than others, but the Lappeenranta University provides a more environmentally friendly silver extraction method using an ion exchange technique. This technique reduces the amount of input and output. Although this ion exchange technique is more work, it saves money and helps the environment <span style="font-size: 13px;">(Environmentally).  </span></p><p>With regards to mining in Nevada, the Nevada Mining Association or NVMA's committee keeps new developments abroad on the   state and federal levels. With the help of this association a mining operation may be helped with other concerning activities such as effective reclamation productive post-closure-landscapes, industry initiatives, wildlife conservation, and much more. looking into this association would aid a novice miner greatly (Whaley).     </p><p>The International Council of Mining and Metals creates policies for mining with regards to reduced inputs, reduced outputs, and environmentally sustainable mining. The council's main purpose is to ensure a stable and sustainable mining technique using the most environmentally friendly uses. The International Council of mining and metals creates a huge impact on the mining industry, big or small, on how to use resources better and wiser which should be noted when starting an operation (How). </p><p>-SA </p>]]></description>

         <title>Federalism Analysis. </title>

         <description><![CDATA[<p>Generally, mining is a power given to the states.  This is a representation of dual federalism.  As stated by the BLM "Federal law simply specifies that claim and site boundaries
must be distinctly and clearly marked to be readily
identifiable on the ground. The General Mining Law allows States to establish their own laws regarding the manner in which mining claims and sites are located and recorded (Mining Frequently. Department, Interior). "  Therefore the states operate in their own spheres; establishing their own claim processes.</p><p>However, the House Committee on Natural Resources is talking about imposing royalties on mining companies to conform to environmental standards (Mining Claims).  This is an example of Fiscal Federalism and an unfunded mandate. </p><p>In 2002, California became the first state where it was required that open pit mines be refilled after they were closed (Mining Claims).  This is an example of a state being a laboratory in dual federalism.  However, as a result many miners have moved to safer places like Nevada where regulations are smaller. &nbsp;</p><p><span style="font-size: 13px;">The commerce clause comes into play after a mine has been staked and mined.  The distribution of the silver across state lines is federal government regulated.  </span></p><p>In Idaho, the supremacy clause is being exemplified.  Miners were posting claimant signs on Forest Service land, and treating it as private property.  However, this interferes with the mining law of 1955.  The Forest Service is planning to take it up with the Department of the Interior.  if the Forest Service {Federal Government} succeeds, the supremeacy clause will have been enacated { federal gov. winning over the local miners} (Swearingen) -KM</p>]]></description>
