They hear all summary offences that are within their jurisdiction, for example, a motoring offence. Together they decide if the defendant is guilty or not guilty, if they collectively can't come to a conclusion, the chair will make the final decision and decides on the final verdict. So, the role of magistrates is to come to the final decision together.&nbsp;<br><br>In a magistrates there is also the Clark. The Clark makes sure that all procedures at followed and all the decisions made by the magistrates are legal and right. The Clark will also provide support of a defendant is unpresented. If they have nobody with them to defend their argument, the Clark will provide support to the defendant. </div>]]></description>

These are the people that discuss the case and decide whether the defendant is guilty or not guilty and they are not legally trained. If 2 of the magistrates cannot decide on a verdict , the chair has the deciding vote.&nbsp;<br><br>Also, there is the clerk of court. This is the legally trained person who makes sure procedures are followed and makes sure everything runs properly. For example, if the defendant is unrepresented, the clerk of court &nbsp;ensures they can get a fair trial. </div>]]></description>

         <description><![CDATA[<div>There are many people who work in the magistrates court, such as the magistrates, the chair/chairman of the bench, a Clark , a prosecution lawyer, an usher and defence solicitor. <br>The 3 magistrates hear all the evidence in the court and decide whether the defendant is guilty or not, the chairman of the bench has the deciding vote in the cases, the Clark makes sure that all proper procedures are followed, the usher fetches the witnesses, the prosecution lawyer proves that the offence has been committed by the defendant and has to make sure that all evidence is present and lastly the defence solicitor protect the interests of their clients and can challenge or exclude evidence.</div>]]></description>

         <description><![CDATA[<div>In a magistrate court magistrate works<br>who decides whether D is guilty or not guilty and the prosecution will prove the D is beyond the reasonable doubt otherwise the trial will be dismissed. There are usually 3 magistrates and they are usually not legally qualified and also are not paid. They hear summary offences ( common assault) and triable either way (theft) and if the case is more serious they pass it to crown court. There is legal advisor in magistrate court whose job is to ensure that everything is run properly and will enter the D in plea. There are other people who are in magistrate court like defence solicitor who’s role is to or e the prosecution wrong and usher role is to ensure the D has answered all questions and will say “all rise”</div>]]></description>

The Magistrates are not legally qualified hence , they don't hear too serious cases like ,&nbsp; Murders etc.Magistrate court hears the evidences , prosecution's perspective and defence's perspective for the first time and decide whether the defendant is guilty or not. And pass a sentence if guilty or dismiss the case if not . The prosecution proves three things mainly "Offence is committed"&nbsp;<br>" The defendant has committed the crime " and " Present all correct evidences " .A legal advisor is also present in magistrates court who ensures everything is properly arranged . Defence and prosecutor solicitors are also present . They protect the interest of their clients. </div>]]></description>
