Compared with the United States Constitution

Because the United States Constitution was written in 1787 and the Constitution of Angola was written in 2010, the latter seems to be more progressive and focused on conserving our planet. The two Constitutions are very similar in that they protect many individual rights, and many of the same individual rights at that. The Constitution of Angola seems to give those rights to a wider range of people than the United States Constitution originally did. For example, the Constitution of Angola states that everyone should be equal, regardless of sex, ancestry, or race. This was unheard of back when the United States Constitution was written and ratified. Despite the differences in the two Constitutions, there seems to be an undeniable link between the two in that the purpose of government never really changes. Newer Constitutions will surely deal with newer problems, but the framework and foundation of any democratic government will always be essentially the same.

Effect of the Times on the Constitution

Due to the times in which the Constitution of Angola was written (2010), there seems to be a focus on protecting the individual as well as their family. Also, the idea of conservation with regards to the environment is explicitly written into the Constitution. It spells out early on that no one is to be discriminated against based on numerous factors, which is a topic of hot debate in the United States even today, This bit seems to show a bit more progressiveness, a sign of the modernity of the Constitution.

As was the case with previous Angolan Constitutions, the freedom of the press and freedom of religion are guaranteed. The death penalty and torture are also still banned. The 2010 Constitution states that no one may be discriminated against based on ancestry, sex, race, ethnicity, color, disability, language, place of birth, religion, political, ideological or philosophical beliefs, level of education or economic, social or professional status. The home is very strongly respected as is the idea of family. Acts that harm the environment are punishable by law. Finally, all citizens over the age of 18 have the right to vote.

The Constitution of Angola was ratified by the Angolan Parliament, through the Constituent Assembly with a vote of 186 in favor to 0 against. The percent of votes in favor was exactly equal to the percent majority of the leading party. Those who opposed the new Constitution simply boycotted the vote. It was also approved by the incumbent President Jose Eduardo dos Santos and the Constitutional Court.

The Constitution of Angola gave more power to the Executive branch than before. It simply threw out the idea of presidential elections, stating that the president would be the leader of the party with the parliamentary majority. Unlike the writing of the United States Constitution, the public was allowed to suggest changes and edits to the Constitution before it was ratified. The Constitution contains 244 articles, many of which were revised when the public was consulted.
