         <description><![CDATA[<p>“The relationship between students and their school counselor requires an atmosphere of trust and confidence.” (The School Counselor and Confidentiality - American School Counselor Association (ASCA), 2022). This concept of confidentiality when it comes to School Counseling is made to protect students from themselves and others, this extends to school staff, parents, and law enforcement in some cases. Keep information confidential unless legal requirements demand confidential information be revealed or a breach is required to prevent serious and foreseeable harm to the student or others. Serious and foreseeable harm is different for each minor in schools and is determined by a student’s developmental and chronological age, the setting, parental/guardian rights and the nature of the harm. School counselors consult with appropriate professionals when in doubt as to the validity of an exception.” (American School Counselor Association. A.2 Confidentiality (f), 2022c )</p><p><br/></p><p>In the case of a student expressing suicidal ideations, the duty to warn supersedes confidentiality. A counselor may need to break confidentiality in a situation like this.</p>]]></description>

         <description><![CDATA[<p>District policies must be clear and across the board in order to avoid gray areas. These policies should include the district's stance on confidentiality and expectations as well as possible consequences for not adhering to said expectations. In addition, the district should include the federal and state laws that coincide with their own policies.</p><p><br/></p><p>Under FERPA §99.7</p><p>"(a)(1) Each educational agency or institution shall annually notify parents of students currently in attendance, or eligible students currently in attendance, of their rights under the Act and this part.</p><p>(2) The notice must inform parents or eligible students that they have the right to—</p><p>(i) Inspect and review the student's education records;</p><p>(ii) Seek amendment of the student's education records that the parent or eligible student believes to be inaccurate, misleading, or otherwise in violation of the student's privacy rights;</p><p>(iii) Consent to disclosures of personally identifiable information contained in the student's education records, except to the extent that the Act and §99.31 authorize disclosure without consent; and</p><p>(iv) File with the Department a complaint under §§99.63 and 99.64 concerning alleged failures by the educational agency or institution to comply with the requirements of the Act and this part.</p><p>(3) The notice must include all of the following:</p><p>(i) The procedure for exercising the right to inspect and review education records.</p><p>(ii) The procedure for requesting amendment of records under §99.20.</p><p>(iii) If the educational agency or institution has a policy of disclosing education records under §99.31(a)(1), a specification of criteria for determining who constitutes a school official and what constitutes a legitimate educational interest.</p><p>(b) An educational agency or institution may provide this notice by any means that are reasonably likely to inform the parents or eligible students of their rights.</p><p>(1) An educational agency or institution shall effectively notify parents or eligible students who are disabled.</p><p>(2) An agency or institution of elementary or secondary education shall effectively notify parents who have a primary or home language other than English." </p><p>(<em>FERPA | Protecting Student Privacy</em>, n.d.)</p>]]></description>

         <description><![CDATA[<p>As an aspiring school counselor and someone who currently works alongside school counselors, my daily practice is guided under the legal regulation of FERPA and the TEC, as well as the ethical frameworks of ASCA, specifically their fundamentals of confidentiality. These guides provide clear boundaries of right and wrong, the compliance of which ensures accountability and defensibility, even when outcomes are sometimes unfavorable. Respecting student confidentiality and autonomy, as mandated by FERPA the TEC offer essential guidance, aligning and reassuring the correct and procedural actions are being taken. Similarly, the ethical guidelines provided by ASCA do not necessarily <em>form</em> my personal ethical conduct, the reinforce rather than replace ethical obligations to students and stakeholders.</p>]]></description>

         <description><![CDATA[<ul><li><p>Promote to school staff the ethical standards that school counselors adhere to via talks during professional development, regularly giving information. </p></li><li><p>Via handbooks, information sessions, and social media explain the legal limitations of confidentiality both annually as mandated and regularly.</p></li><li><p>Advocate for the use of secure sharing of data electronically, ensuring that yourself and staff adhere to federal, state, and local laws and policy on data sharing. If necessary, sensitive information should be shared via phone call or in-person rather than email.</p></li><li><p>Unless legally obligated in order to prevent harm to a student or others, information is to keep confidential. "Inform parents/guardians and/or appropriate authorities when a student poses a serious and foreseeable risk of harm to self or others. When feasible, this is to be done after careful deliberation and consultation with other appropriate professionals. School counselors inform students of the school counselor’s legal and ethical obligations to report the concern to the appropriate authorities unless it is appropriate to withhold this information to protect the student (e.g. student might run away if he/she knows parents are being called). The consequence of the risk of not giving parents/ guardians a chance to intervene on behalf of their child is too great." (ASCA National Model, n.d. A.9. (a).</p></li><li><p>Refrain from sharing information that can be considered confidential electronically as much as possible, whether that means non-directory information or possible breaches in information given confidence.
