Ancak 1999 ve 2002 yılından bu yana adli kolluk kuruluşunun uygulamaya geçileceği belirtilmesine ve 2005 yılında Türkiye'de yapılan yargı reformu doğrultusunda ceza muhakemesine yardımcı olması için yeniden yapılandırılan ve oluşturulan Türk Ceza Muhakemesi Kanununun 167. maddesine dayanılarak çıkartılan Türk Adli Kolluk Yönetmeliği çıkartılmasına rağmen tam anlamıyla adli kolluk kuvveti uygulamasına geçilememiştir. Yalnızca yapılan toplantılar ile geçilmesine çalışılmaktadır. Bu duruma Avrupa Birliği üyeliğine hazırlanan Türkiye hakkında düzenlenen ilerleme raporlarında da yer verilmektedir.
