This is because the penalties received in ancient Babylonia were based on social status, while we now have rule of law, meaning that everyone must be punished equally. The penalties for crimes in ancient Babylonia were also harsher than today because many of the crimes stated in the code would now be considered cruel and unusual punishments. For example, law 22 states that a person caught committing robbery would be put to death. Today, that would be considered a violation of our eighth amendment rights because the death sentence is too great of a punishment for a simple robbery.
