Section 1414 - Individuals with Disabilities Education Act

IDEA is the law that provides children with disabilities with an education as well as special education services to assist them throughout their schooling.  Under the IDEA Act, the Individualized Education Program will state the student's current academic achievement, performance ability, and activities as well as how the child's disability impacts his or her ability to perform on grade level.  The IEP will state the services the student receive, so that the staff members will know which modifications to apply and the personnel staff involved.

Judicial Law

The Board of Education v. Rowley determined the student must receive a free appropriate public education suitable for his or her disability and academic needs.  Justice White determined Rowley was provided a FAPE.  However, the services provided under the IDEA Act did not allow her to perform to her potential. 

Under the FAPE, each state must ensure that a child with a disability is receiving appropriate services. These services begin at the age of 3.

If a student in a general class is experiencing difficulty with interventions, the student shall be further evaluated.  Once the student is evaluated, results will determine if the student qualifies for Special Education services.  As a result, for qualifying and parents consenting, support services deemed appropriate will be provided. An Individualized Education Program is created for the student.

The 14th Amendment provides equal protection to the citizens.  The United States and states individually will protect citizens and not deprive them of their rights. Therefore, under the IDEA Act and FAPE, students with disabilities have a right to an education and shall receive services according to their disability and IEP.
