         <description><![CDATA[<div>My professional prospective is working as a teacher. This is my eighth year of teaching. I am currently working on my graduate degree in guidance and counseling from Angelo State University. I previously received my undergraduate degree through Angelo State University. I am working towards becoming a certified school counselor and principal. This legal guide padlet on a Reduction in Force (RIF) is for teachers to use as reference for the legal and ethical requirements for a RIF and how it works. I chose this topic because of a previous conversation with my administrator. I asked him what was one of the toughest things he had to do as an administrator. He explained that being an administrator during a RIF is the worst thing he has ever had to do and will strive to never have to do one again. I had never considered being at a school while going through a RIF but this conversation made me recognize that this could happen and how important it is to be prepared for it. </div>]]></description>

         <description><![CDATA[<div>I interviewed Jason Powers, the current Elementary Principal for Blackwell CISD about what constitutes for a RIF, how a RIF works, what his duties were as an administrator, and his educational implications after carrying out a RIF. <br><a href="https://www.blackwellhornets.org/apps/staff/">https://www.blackwellhornets.org/apps/staff/</a><br><br><strong>What is a RIF and how does it work?<br><br></strong>Mr. Powers explained that a RIF is typically due to a program change or financial exigency. He went further to explain that the majority of a schools budget goes towards the staffs salary. The easiest way to cut spending is to reduce the staff. He explained after the school board declares a RIF, the district looks into the needs versus expenditures and determines which positions are imperative to keep and which ones are dispensable. <br><br>B<strong>est Practices during a RIF.</strong></div><ol><li>Follow policy and be honest with people.</li><li>Do a needs assessment.</li><li>No matter your position, know your rights and the rights of others.</li></ol><div><br><strong>Emerging issue relating to RIFs</strong><br><br>Educators should watch any budget cuts their district is going through. Educators should also watch for any changes in finance laws. Mr. Powers explained all of the RIFs he is knowledgeable of have dealt with financial exigency. So being aware of the laws and your districts budget will help to be knowledgeable about if your district is at risk for a RIF. </div><div><br></div>]]></description>

         <description><![CDATA[<div>The National Education Association released an article on the impact of budget cuts and teacher layoff. If a school is going through budget cuts and lays off teachers, the direct result for the teachers left are larger class sizes. This article relates to my topic because a RIF reduces the amount of teachers at a school and not the amount of students. <br>Teachers are also worried about the increased class sizes but no increase in funding to support the classroom. (Will your RIF be based on evaluations or seniority?)</li><li>Strive to receive good evaluations from administrators. </li><li>Become a member of a professional organization. (Many offer assistance from lawyers.)</li><li>Be knowledgeable of State and Federal laws and regulations relating to a RIF.</li><li>If you are in a RIF-able position, be prepared to obtain certifications in other areas.</li><li>Consult legal counsel if you feel like your rights have been violated. </li></ol><div><br></div>]]></description>

Code § 44.011 regarding financial exigency.</div><ul><li>The school board may declare financial exigency for the school district.</li><li>The declaration will expire at the end of the school year unless the school board declares a continuations of financial exigency. </li><li>The school board is not limited in the number of times they can declare financial exigency but they must notify the commissioner each time.          <description><![CDATA[<ul><li>The SAISD board of trustees approved trimming teacher and administration positions from its payroll.</li><li>According to district policy, the Superintendent has "legal authority to make staffing changes based on performance evaluation rather than seniority"(Phillips, 2018). </li><li>The Superintendent claims worst cases scenario, five percent of employees could be layed off. (approximately 350 positions)</li><li>The Superintendent claims "enacting the reduction in force proceedings will help him keep his strongest teachers"(Phillips, 2018).</li><li>In this case, assistant principals and central office staff are more likely to be affected by the RIF than teachers. </li><li>The district lost more than 2,000 students and is projected to lose 800 more students.
