After my exploration of legal and ethical issues in curriculum and instruction, I am most interested in exploring ownership of teacher-created materials. This is interesting to me because teachers use many resources to create lessons and activities to meet the students' needs best. I found two different perspectives about teachers selling teacher-created materials online.

Exploring Legal and Ethical Issues Summary

In my exploration of legal and ethical issues, I came across the ethical question about teachers selling or sharing lesson plans. The question to share or sell lessons is not new to education, but the popularity of sites like Teachers Pay Teachers and others has made selling lessons more popular. This is important to educators because when purchasing or selling a lesson educators need to be aware of copyright infringement. The two resources I explored address the ethical issue of selling and sharing and legal issues of ownership and plagiarism.

The ethical question of educators selling verses sharing lesson plans is two-sided. On the one hand, educators should be able to sell his or her lesson to supplement his or her income. However, the other side argues that selling lessons “cheapens” the profession (Schwartz, 2018). The legal question asked in both articles was who owned the lesson plans? When an educator creates a lesson, does the lesson belong to the teacher or the district? According to the Copyright Act of 1975 states that the lesson is “work-for-hire” and is the property of the district (Greene, 2016). Another legal issue explored was plagiarism and copyright infringement. With the free online sharing sites and the online market for lessons, there is an increase of copied work. An example is an educator finding an idea online and then changing a few things and passing the work off is his or her own (Schwartz, 2018).

The impact of the legal and ethical issues for educators comes down to the quality of the curriculum. With the popularity of online sources, the coherence of the curriculum suffers. As a curriculum coordinator, I would need to be aware of the legal and ethical issues that come with educator created materials preventing the misuse of such materials. In my feature position, I may also be responsible for planning or presenting development on ownership of teacher-created materials.
