I understand where you’re coming from, an FBA is definitely a process that takes some time and effort to conduct. However, FBAs are actually required by law under the provision of the IDEA, it states that all children with disability needs to have access to the least restrictive environment. In this case, an FBA ensures that the client have access to that right.

The reason why we do this is to determine the current repertoire of the client so that effective interventions can be developed. And according to the ethics code, behavior analyst is required to conduct a functional assessment when developing a behavior-reduction program (3.01). Up until now, the interventions I have developed has not been shown to be effective, and I believe that an FBA is going to necessary for the best interest of our client as well as other students in that classroom. I know it is against your wishes for me to bring up the FBA during the next IEP, but in order for parents to make the best decision for their child, I am obligated to bring up this issue.

Kevin – Principal

Justin – BCBA

Veronica – Teacher

Pastora – Psychologist

I understand your concerns and I appreciate that you are interested in the student’s future, however, as a Board Certified Behavior Analyst I am responsible for following ethical codes in order to provide individualized and effective treatment for the client. I agree that an intervention needs to be put in place. I have began assessing the behavior and taking baseline data as it is required by ethical code 3.0. Based on baseline data, I have analyzed that client is only meeting the IEP goal at 55%. Therefore, the next step would be to conduct a functional behavior assessment to understand the primary function of the behavior and to find out under what conditions the behavior is most likely to occur or not occur. Also, according to the ethical code 4.02, parents have the right to any report updates pertaining to their child. It’s crucial for the Behavior Analyst to involve the clients parents in the planning of and consent for behavior-change programs. In addition, ethical code 4.03 states that behavior analysts must tailor behavior-change programs to the unique behaviors, environmental variables, and assessment results of each client. To meet your needs of creating an intervention for this student, I need to implement an FBA as this will allow me to tailor the intervention for this student.

Principal- Hilary

BCBA Clinical Director- Martha

BCBA- Nayelli

Parent- Anessa

Teacher - Andrea

We would just explain why we think it is important for the student to have an FBA conducted. Due to the fact that it is legally and ethically required to do so. We would suggest a meeting with all the important personnel who provide services to the student.

- Liz, Fi, & Sasha (*missing Jules)

FBA- Response to Principle

Thank you for your opinion. However, we have been observing and taking data during this school year and there is no progress as this student is only completing 57% of course work and only meeting his IEP goals 55% of the time. The school psychologist and OT have also reported there has not been any improvement in the student’s behavior. Additionally, the teacher has reported that it is difficult to prompt the student because it is taking away time from her instructional time with other students when it is not helping the student improve in class. Therefore, an FBA is recommended to create an behavior change plan. According to the ethical guideline 3.01 Behavior Analytic Assessment (RBT), a behavior analyst must conduct an assessment before making any recommendations or creating a behavior-change program, so a intervention program cannot be created from unstructured observations. Creating an intervention plan without an FBA does not allow for parental consent (4.02), which is required before any assessments or interventions plans are created. They must be informed before implementing an intervention. Parental consent is crucial because parents may have conflicting opinions with what is recommended to be implemented. With consent, the BCBA can clarify behavioral objectives and intervention goals.

In order for a Behavior Analyst to comply with code 4.06 Describing Conditions for Behavior Change Program Success, the analyst is required to complete an FBA. In order to describe the conditions needed for the BSP to be successful an FBA must be conducted. Through the FBA, the behavior will be observed and the function of it will be assessed to create a BSP. There are many ethical guidelines that require Behavior Analyst to conduct and FBA before any intervention plan is created or implemented as well as it is legally required.

The BACB professional ethics code dictates when to conduct a behavioral assessment, under which this case qualifies. Further, it is my ethical responsibility to describe to shareholders, including yourself, the conditions necessary for the implementation of the intervention in order to allow the student’s success, which is our priority and factors that might prevent it from being properly implemented. An FBA is necessary to move forward with conceptualization to implementation for the behavior change. Right now, I am trying to do my duty as a behavioral analyst in describing to you the environmental conditions that are necessary in order for the intervention to be successful and ethical. If you do not allow me to do this, I will need to write it in a report, for presenting at the next IEP so that the team can likewise understand my recommendations for an FBA and its limitations, and we can go forward from there.

I understand your concerns, AND according to the ethical guidelines I adhere to as a BCBA, an FBA is warranted for this child. So far, he has not met any of his academic and behavioral goals. The teacher and the OT have expressed concerns about the child not meeting his goals. In order to implement an effective intervention, an FBA should be conducted. I understand that this may present some financial concerns for you, but as ethical professionals, we must place the client’s needs above everything else.

Joanna, Aaron, Jackie, Harold
