Freedom of expression is the foundation of a functioning democracy. 
 The Supreme Court of Canada has said these freedoms are essential for:
  • Self-fulfilment
  • Participation in social and political decision-making
  • The free exchange of ideas

  • These freedoms are not absolute. The Charter allows the government to set "reasonable limitations" to protect people. 
  • Under section 1 (The Reasonable Limits Clause) of the Charter, laws linking to things like defamation, obscenity, censorship, hate crimes, public mischief and publication bans can limit the freedom of expression.
  • Example: You cannot falsely yell fire in a crowded theatre.

  • The charter guarantees Canadian citizens, permanent residents and newcomers freedom of thought, belief, opinion and expression. 
  • All the rights and freedoms in the charter are entrenched in the constitution, as a result, amending them would be difficult. 
  • The courts have to interpret what the words used in the charter mean when looking at a case. If you think your freedoms have been infringed, you can seek a legal remedy(seeing if a judge agrees with you and then finding a solution using the law).

  • Carolyn Storm, a nurse, is appealing a Court of Queen's Bench decision for a $26,000 fine she received after she published a Facebook post criticizing her grandfather's end-of-life care and some unnamed staff in 2015.
  • The court of appeal (The province's highest court) reserved its decision. This has not changed since the article was published.
  • In 2016, the Saskatchewan Registered Nurses Association (SRNA) found her guilty of professional misconduct and gave her the financial penalty. They believed that she should have filed a complaint formally. 
  • She said that the care at St. Joseph's Health Facility was "subpar" but the staff protested her statement. She believes that the fine violated her freedom of thought, belief and expression.
  • This case questions if health-care professionals have the freedom of expression to post whatever they wish and publicly criticize health-care facilities without receiving all the facts from the administration. It is unclear whether an individual's freedom of thought, belief, opinion and expression should be restricted because of their career.
