         <description><![CDATA[<div>Herman was caught by the police following a report made by villagers of Kampung Tengah on Sunday, 11 September 2017. According to the report, Herman was found suspiciously lurking in an abandoned house together with another two man. <br><br>The villagers often saw Herman there, doing drugs with his friends. When he was caught by the police, he was holding a needle to his arm and was slightly unconscious.<br><br>Herman was brought to the police station and detained for ten days. During the period of detention he was not allowed to see his family members or contact anyone. When he asked to call a lawyer, the police denied his request. Herman was also frequently beaten, and starved. Herman argued that the detention was unlawful as he was not given the rights to call a lawyer under Article 5 of the Federal Constitution. He also claimed for habeas corpus since his detention was unlawful as it was not done according to the law.<br><br>Which of the above are matters of fact and matters of law? <br><br>Discuss. </div>]]></description>
