I chose this topic because I want to understand all my legal responsibilities regarding reporting child abuse to protect myself and the students I serve. </p><p>The audience are fellow school counselors wanting to learn more about their responsibilities. </p>]]></description>

         <description><![CDATA[<p>The governing body responsible for compliance in everything a school counselor does is the Texas Education Agency (TEA). TEA is a state sanctioned agency committed to improving public education in the state of Texas. One of their responsibilities is to “monitor for compliance with certain federal and state guidelines” (TEA, 2024, section Roles and Responsibilities).</p>]]></description>

         <description><![CDATA[<p>US. Constitutional Law- The 14th amendment in the U.S. constitution outlines citizen’s rights that no state shall “deprive any person of life or liberty” (U.S. Const. amend. 14, § 1). I would argue that child abuse is a deprivation of life and liberty and therefore requires reporting and due process of law.&nbsp;</p><p><a rel="noopener noreferrer nofollow" href="https://constitution.congress.gov/constitution/amendment-14/">https://constitution.congress.gov/constitution/amendment-14/</a> </p><p>State Law- Section 3 of the Texas Constitution outlines the equal rights that all people have in Texas (Tex Const. art. 1, § 3).          <description><![CDATA[<p><em>Doe v. Unified School District</em> is a court case against Jane Doe and the school district. Jane Doe’s friends reported to the school counselor that she was being sexual abused by her step father. The school counselor reported the abuse to the proper authorities but did not reach out to Jane Doe’s parents or teachers to gather more information. Doe’s mother brought this case to court to argue she should have been made aware of the situation (<em>Doe v. Unified School Dist.</em>, 2003). No definitive conclusion was reach of who was “right” or “wrong”, but it is a good reminder of the requirement that school counselors are mandated reporters.&nbsp;</p><p><a rel="noopener noreferrer nofollow" href="https://www.schoolcounselor.org/About-School-Counseling/Ethical-Responsibilities/ASCA-Ethical-Standards-for-School-Counselors-(1)">https://law.justia.com/cases/federal/district-courts/FSupp2/255/1239/2562555/</a>&nbsp;</p>]]></description>

         <description><![CDATA[<p>Researching the context of the legal and ethical laws surrounding mandated reporting has helped me better understand my responsibility as a school counselor. I have been an educator for 5 years and educators are also held to this standard, so I am very familiar with it. However, ASCA points up that school counselor are held to a higher standard in regards to reporting abuse (ASCA, 2018). </p><p>As a school counselor, we want to take care of the students under our influence. We want to show them they are loved, important, and valuable. However, we also want them to be safe. If anyone is infringing on the safety of our students, we want to step in to change that as soon as possible! I have a responsibility and a desire to report any abuse of a child to keep by students safe. </p>]]></description>

         <description><![CDATA[<ul><li><p>When a student reports abuse, take it seriously. </p></li><li><p>Report suspected abuse within 48 hours.</p></li><li><p>Talk with a supervisor on if parents need to be made aware of abuse (see court case).</p></li><li><p>Follow up with the student to see how they are doing.</p></li><li><p>Follow up with authorities you reported too.</p></li><li><p>Consider looping in other staff members who would need to be aware of the situation.</p></li><li><p>Do not share information with anyone who does not need to know.</p></li></ul><p><br/></p>]]></description>
